Ms. Nguyen Thi Thanh Tam is a high school teacher, on maternity leave from May 29 to November 28, 2024. The time when I took maternity leave coincided with the summer vacation, so the management agency allowed me to take a compensatory 12 days off. Ms. Tam asked, will I receive full salary for 12 days off or unpaid leave?
The Ministry of Education and Training responds to this issue as follows:
According to Article 3 of Decree No. 84/2020/ND-CP dated July 17, 2020 of the Government detailing a number of articles of the Law on Education, the annual summer vacation for teachers at general education institutions is 8 weeks, including annual leave.

In case Ms. Nguyen Thi Thanh Tam is on maternity leave from May 29, 2024 to November 28, 2024, because it completely coincides with the summer vacation of the 2023-2024 school year, she is entitled to compensatory leave under the annual leave regime and is entitled to full salary according to the provisions of Clause 1, Article 113 of the Labor Code 2019 and instructions in Official Dispatch No. 1125/NGCBQLGD-CSNGCB dated August 18, 2017 of the Department of Teachers and Educational Managers, Ministry of Education and Training.
