Mr. N.V.H said that he graduated from the University of Political Education. In 2022, he was recruited by the Department of Labor, Invalids and Social Affairs to the position of Political Education Teacher at Thanh Binh Intermediate School and was exempted from probation because he had working time and compulsory social insurance contributions that met the conditions according to Clause 5, Article 21 of Decree 115/2020/ND-CP.
In 2023, Mr. H continued to be admitted to the civil servant position of the Department of Education and Training, the position of high school teacher rank III, teaching Civic Education. Thus, both recruitments were in the same training major (Political Education) and the same teaching profession (Civil Education/Political Education), only different from the managing unit. However, the recruitment decision of the Department of Education and Training required Mr. N.V.H to re-examine.

I think this regulation is inappropriate because:
I have been legally exempted from internships in accordance with regulations;
Teaching work is in accordance with the training major, without changing the nature of the profession;
Cases of considering transferring jobs from Intermediate Schools are still recognized as being exempt from internships and suitable for their expertise, while I also came from Intermediate School but was not recognized through the entrance exam, leading to irrationality and inconsistency" - Mr. H reflected inadequacies.
Regarding this reflection, the Ministry of Education and Training said that the information provided by Mr. N.V.H is not clear about the exact time of the recruitment decision to become a teacher at the high school. Therefore, in the case of Mr. N.V.H being recruited before December 7, 2023, the probation exemption is implemented according to the provisions of Clause 5, Article 21 of Decree 115/2020/ND-CP;
In case Mr. N.V.H is recruited after December 7, 2023, the probation exemption is implemented according to the provisions of Clause 12, Article 1 of Decree 85/2023/ND-CP.
According to the provisions of point b, clause 3, Article 9 of Circular No. 04/2021/TT-BGDDT, which has been amended in clause 6, Article 4 of Circular No. 08/2023/TT-BGDDT, people with a bachelor's degree in Political Education are determined to meet the standard level of training to teach Economic and Legal Education (according to the old program called Civic Education).
According to information provided by Mr. N.V.H, before being recruited to teach Civic Education at a high school, he was a teacher teaching Political Education at a secondary school. Thus, in 2023 (the time of recruitment as a teacher of Civic Education at a high school), he was arranged to work according to the training major and according to the professional expertise of the work he had previously undertaken.
However, the information provided by Mr. N.V.H is unclear about whether the working periods with compulsory social insurance contributions before (time teaching political education/civil education subjects) are equivalent to or greater than the 12-month probation period for high school teachers.
Therefore, the Ministry of Education and Training does not have enough grounds to determine whether Mr. N.V.H is eligible for probation exemption. Therefore, the Ministry requests Mr. N.V.H to provide complete dossiers and documents proving his qualifications, training majors, and teaching time in Political Education/Citizen Education before being recruited as a high school teacher to the Department of Education and Training for specific answers.
