Mr. Phan Lap applied for the position of Librarian Level IV, code V.10.02.07. He completed his internship from November 1, 2023.
Mr. Lap asked, if he has a university degree in Library Science, will he be appointed and have his salary ranked at level 2/12 or 3/12 of the professional title of Level IV Librarian?
The Ministry of Culture, Sports and Tourism responded to this issue on the Government Electronic Information Portal as follows:
Regarding the salary arrangement for civil servants after the end of the probationary period as prescribed in Clause 2, Article 9 of Circular No. 02/2022/TT-BVHTTDL dated July 1, 2022 of the Minister of Culture, Sports and Tourism.
Applicable to the case of recruiting civil servants holding the professional title of Grade III Librarian with a university degree or higher (university, master's, doctoral training level), Grade IV Librarian with a secondary school degree or higher (intermediate, college training level) suitable for the recruited job position, after completing the probationary period as prescribed and being appointed to the professional title by the competent authority managing civil servants according to the provisions of Article 24 of Decree No. 115/2020/ND-CP dated September 25, 2020 of the Government regulating the recruitment, use and management of civil servants.
On December 7, 2023, the Government issued Decree No. 85/2023/ND-CP amending and supplementing a number of articles of Decree No. 115/2020/ND-CP (effective from December 7, 2023).
Accordingly, based on the salary level in the recruitment decision for cases requiring probationary period (Clause 1 and Clause 2, Article 23 of Decree No. 115/2020/ND-CP, amended and supplemented according to the provisions of Clause 13, Article 1 of Decree No. 85/2023/ND-CP) or cases not requiring probationary period (Clause 5, Article 21 of Decree No. 115/2020/ND-CP, amended and supplemented according to the provisions of Clause 12, Article 1 of Decree No. 85/2021/ND-CP), the competent authority shall decide to appoint professional titles and arrange salaries for recruited civil servants after the end of the probationary period according to the provisions of Article 24 of Decree No. 115/2020/ND-CP.
Article 24 of Decree No. 115/2020/ND-CP stipulates the appointment to professional titles of civil servants for interns after the end of the probationary period as follows:
1. At the end of the internship period, the intern must report the internship results in writing according to the contents specified in Clause 3, Article 21 of this Decree; the intern instructor is responsible for commenting and evaluating the internship results of the intern in writing. These documents are sent to the head of the public service unit.
2. No later than 5 working days from the date of receipt of the trainee's report and comments and evaluations from the trainee's supervisor, the head of the public service unit shall evaluate the trainee's political qualities, ethics and work results. In case the trainee meets the requirements, the head of the public service unit shall decide according to his/her authority or issue a written request to the competent authority managing the public service unit to decide on the appointment of professional titles and salary for the recruited civil servant.
