The regulation is part of the regulations on transferring and reassigning teachers and management officials at public educational institutions, issued by Cao Bang Provincial People's Committee in early September 2026.
Accordingly, the working time for considering transfer conditions is calculated from the date the teacher is recruited.
In addition to people who have not worked for 3 years, teachers who are being considered and disciplined; who are being inspected, verified, inspected, investigated, prosecuted, or tried are also not allowed to be transferred.
When transferring to another job, the educational institution where the teacher is transferred terminates the contract; the school, agency or unit where the transfer is made receives them. The transfer must be completed before August 31 every year.
With the form of temporary transfer, teachers are transferred from one public school to another for a period of no more than 36 months.
After completing at least half of the mobilization period, teachers may be considered to return before the deadline if they themselves or their relatives directly suffer from a serious illness, or have special circumstances such as accidents, injuries that require treatment for 30 days or more without relatives taking care of and nurturing them.
Direct relatives include biological parents; father, mother-in-law or husband living together in the family; wife or husband; children.
Teachers are also considered for early resolution if someone else voluntarily comes to the school to be strengthened for replacement, and is agreed by the competent authority managing civil servants. The condition that at least half of the mobilization period has been implemented still applies to this case.
After the deadline, teachers are considered to return to their old school or go to another public school according to their wishes if there are still staff quotas.
The competent authority and the school are responsible for arranging work after the transfer. The transfer must be completed before August 31 every year.
For school administrators, the transfer and appointment must be in accordance with the requirements of the task, the scale of the school and the term of office as prescribed.
At the merged schools, the term of office to carry out the transfer is calculated from the time of the merger.
If transferring and appointing management officials between two commune-level administrative units, localities must review positions, standards, personnel conditions, unify plans and report to the Department of Education and Training to implement the process. This must ensure that management and administration activities of the school are not interrupted.
The Department of Education and Training is assigned to guide and inspect the implementation of the regulations, and report the results to the Provincial People's Committee in December every year. The commune and ward authorities are responsible for the transfer and relocation within their management scope.
