Clarify the authority to transfer teachers
The Ministry of Education and Training is seeking opinions on the draft Decree detailing a number of articles of the Law on Teachers.
One of the notable new points of the draft is clearly defining the authority to transfer teachers according to the new local government organization model, associated with the scope of management of educational institutions.
According to the draft, the Chairman of the Commune-level People's Committee is the person with the authority to transfer teachers, management officials of educational institutions and staff working at public educational institutions under the management of the commune level. This is a new point, in line with the policy of strengthening decentralization and delegation of power in grassroots education management.

For public educational institutions with operating scope from two or more commune-level administrative units, or under the management authority of the provincial level, the Director of the Department of Education and Training will exercise the right to transfer.
For the public vocational education and higher education system, the transfer of teachers is directly decided by the management agency. For schools belonging to the armed forces, the Minister of National Defense and the Minister of Public Security will specify the transfer of teachers within their sector.
The draft also requires the competent agency to clearly stipulate the order, procedures, conditions and dossiers, ensuring publicity, transparency and suitability with local and unit practices.
Expanding and concretizing the groups of mobilized subjects
Compared to previous regulations, the draft decree has more clearly defined the groups of teachers that can be transferred, avoiding widespread and unfounded application.
Transfer subjects include:
Teachers who have been appointed or are in the appointment plan to hold positions of educational institution management officials;
Teachers who have worked in ethnic minority areas, mountainous areas, border areas, islands, and areas with particularly difficult socio-economic conditions for 3 years or more;
Teachers with good professional and professional capacity, with a lot of experience in teaching and education;
Teachers are subject to redundant payroll when implementing the arrangement and reorganization of the network of educational institutions.
The specific listing of target groups is considered a step forward to create a clear legal basis, limiting the situation of subjective mobilization or causing anxiety in the teaching staff.
Preserving regimes and policies, stabilizing teachers' psychology
Another important content is the regime and policies for teachers when being transferred - a long-standing issue that many teachers have complained about is still inadequate.
According to the draft, in the case of teachers holding leadership and management positions who are transferred to new positions with lower position allowances, position allowances are preserved according to the provisions of law. This regulation aims to ensure rights and avoid income disadvantages when implementing transfers due to public service requirements.
For other regimes and policies, teachers will enjoy according to the regime of the place of work. However, if the regime is being enjoyed higher, it will be preserved, creating income stability and work psychology for teachers.
The transfer of teachers is carried out when teachers have needs; ensuring that teachers are convenient in professional activities, feel secure in their work; must have the consent of the educational institution where the teacher is working, the receiving place has needs, and at the same time ensure the appropriate job structure.
The new regulations in the draft decree go in the direction of standardizing authority, clarifying objects, and ensuring the rights of teachers when implementing transfers and transfers.
If approved and implemented synchronously, these regulations are expected to reduce pressure on teachers, limit complaints, and create conditions for the education sector to proactively arrange and use staff suitable to the requirements of innovation and the reality of each locality.
