The Ministry of Education and Training is in the process of finalizing the draft Decree detailing a number of articles of the Law on Teachers, which is being developed by the Ministry of Education and Training (MOET).
In the draft, the Ministry of Education and Training proposed to shift from "promotion" to "professional advancement" (including sequential promotion and unexpected promotion) associated with professional standards and actual achievements; update the spirit of the 2025 Law on Public Employees to ensure modernity and legal unity.
According to the Draft, career promotion consideration is carried out in the form of dossier consideration; The teacher career promotion consideration period is organized on the principle of equality, publicity, transparency, objectivity and compliance with the law.
Standards and conditions for registering for vocational advancement consideration of teachers
Article 7 of the Draft stipulates that teachers are allowed to register for vocational promotion consideration when they meet the following standards and conditions:
Be classified as having good quality at or above completing tasks in the academic year immediately preceding the time of registration for vocational promotion consideration;
Have good political qualities and professional ethics;
Not during the period of considering disciplinary action, disciplinary enforcement or during the period of tham tra, xac minh, conclusion on complaints and denunciations according to regulations on resolving complaints and denunciations;
Meeting the professional standard requirements for the title of teacher participating in professional promotion consideration, except in cases of special promotion consideration.
Vocational advancement registration dossiers of teachers
Article 12 of the Draft stipulates that the professional promotion registration dossier of teachers includes:
Teacher's resume according to the civil servant resume form, compiled no later than 30 days before the deadline for submitting the dossier;
Comments and assessments of heads of educational institutions using teachers on standards and conditions for registering for professional promotion of teachers according to regulations;
Copies of diplomas and certificates required by the title of teacher applying for professional promotion;
Other requirements according to the professional standard regulations of the title of teacher applying for professional promotion.
The content of vocational promotion consideration is to assess the meeting of the requirements for standards and conditions specified according to professional standards of the title of teacher registered for vocational promotion consideration of teachers.
The form is to approve the application for vocational advancement consideration for teachers.
Authority and organization of professional advancement consideration for teachers
Article 8 of the draft stipulates:
For preschool education institutions, general education, continuing education, specialized schools and vocational education centers in the province, the consideration of teacher career advancement is carried out by the Department of Education and Training;
For public vocational education institutions, public higher education institutions, and university preparatory schools, the consideration of teacher career advancement is carried out by the head of the educational institution and is responsible for his decisions;
For non-public educational institutions, the consideration of teacher career advancement is carried out by the head of the educational institution according to the regulations on organization and operation of the educational institution;
For educational institutions under the armed forces, the consideration of teacher career advancement is regulated by the Minister of National Defense and the Minister of Public Security;
For schools of state agencies, political organizations, socio-political organizations implementing training and fostering programs and other programs, the consideration of teacher career advancement is decided by the competent agency managing the educational institution;
For educational institutions not subject to the above regulations, the consideration of teacher career advancement is decided by the competent authority managing the educational institution.
The draft Decree will be submitted to the Government immediately after completing the dossier based on receiving appraisal opinions from the Ministry of Justice and comments from ministries, sectors, and localities.
The expected time for promulgation/passion is January 2026 to ensure the effectiveness of synchronous implementation with the Law on Teachers.
