Ms. Nguyen Thi T. is a teacher at Tran Phu Primary School, tutoring 9 first graders at home. The incident was discovered and the leaders of the Department of Education and Training of Ha Tinh City asked Ms. T. to write a report.
According to Ms. T., the 9 students mentioned above have slow learning ability, so their parents asked her to tutor them to help them progress quickly.
It is known that Ms. T. has 29 years of experience in the education industry, has never violated industry regulations, and is always trusted by parents.
On December 10, 2024, Ms. Tran Thi Thuy Nga - Head of the Department of Education and Training of Ha Tinh City signed document No. 548 reporting the incident.
Accordingly, the Department of Education and Training of Ha Tinh City requested the Principal of Tran Phu Primary School to establish a Disciplinary Council, organize a review, and take disciplinary action against violating officials in accordance with regulations; review the responsibilities of the head and individuals related to the violation of teacher Nguyen Thi T., and report the results to the City People's Committee (through the Department of Education and Training and the Department of Internal Affairs).
At the same time, the People's Committee of Ha Tinh city is requested to transfer Ms. T. to a more difficult area and the Department of Education and Training to issue a document notifying the entire sector about the teacher's violation of regulations on extra teaching and learning.
The above information caused a stir in public opinion. Many people reacted, saying that the proposed measures of the Department of Education and Training of Ha Tinh City were too harsh, causing harm to teachers while extra teaching is common and comes from the needs of parents and students.
Speaking to Lao Dong Newspaper reporters, lawyer Le Dinh Viet (Hanoi Bar Association) said: “In current legal documents, there is no disciplinary measure of “transfer to a more difficult area”, nor is there a provision for “informing the whole sector” for violating civil servants. The Law on Civil Servants and its guiding documents also do not contain any content on the transfer or rotation of civil servants. Therefore, the above proposal and measure of the Department of Education and Training of Ha Tinh City is without legal basis and is not in accordance with regulations.”
