According to the draft Decree stipulating salary policies and allowance regimes for teachers in public educational institutions (currently being sent by the Ministry of Education and Training to the Ministry of Justice for appraisal), teachers will be applied a special salary coefficient, calculated on the current salary coefficient, in order to accurately reflect the nature of pedagogical labor and the specific characteristics of each level of education.
The Ministry of Education and Training proposes the following coefficient levels:
Coefficient 1.15: Applicable to teachers in public educational institutions under the national education system (except for special cases).
Coefficient 1.25: Applicable to teachers in public preschool education institutions.
Coefficient 1,2: Applied to teachers teaching at schools and classes for people with disabilities; centers supporting the development of inclusive education (except preschool); boarding schools in land border areas; teachers teaching at the Ho Chi Minh National Academy of Politics and provincial and city political schools.
Coefficient 1.3: Applied to teachers teaching at schools, classes for people with disabilities and centers supporting the development of inclusive education for preschool children.
Notably, the draft Decree also clearly affirms the rights to wages during summer vacation: Teachers are entitled to full salary and allowances (if any). This regulation aims to remove long-standing obstacles in paying income to teachers during the time they do not directly teach but still perform professional tasks according to assignment.
Regarding the legal basis, Article 16 of the 2025 Law on Teachers (effective from January 1, 2026) stipulates: The annual summer vacation and other days off of teachers are arranged in accordance with each level of education, training level and type of educational institution according to the Government's regulations. This is an important basis to complete sub-law regulations related to the summer vacation regime and teachers' salaries.
Currently, according to point a, clause 1, Article 3 of Decree 84/2020/ND-CP, the summer vacation period for preschool, general education and specialized schools is 08 weeks, including annual leave. In fact, many teachers still participate in training, coaching, and preparing for the new school year during this time, leading to prolonged debates about the calculation of salaries and allowances.
Teachers who are public employees are entitled to annual leave, holidays, and separate leave according to the provisions of labor law. Current law does not have any regulations requiring teachers to be on summer duty.
However, if the school has a plan to arrange teachers to participate in summer duty and is approved by the teachers, the time participating in summer duty will be calculated as overtime and teachers will be paid according to regulations.
The Ministry of Education and Training's proposal to pay salaries and allowances in full during the summer vacation is expected to create unity in implementation, ensure the legitimate rights of teachers, and at the same time contribute to stabilizing the staff and improving the quality of education in the context of implementing the Law on Teachers from 2026.
