Issues regarding salaries, bonuses, allowances, payment of extra teaching salaries... have always been of interest to many teachers across the country and have asked the Ministry of Education and Training. Among them, there is a question from Ms. Nguyen Thi Huong.
Ms. Huong is the Vice Principal of a primary school, concurrently serving as the Chairman of the Trade Union. In the 2023-2024 school year, Ms. Huong teaches 4 periods/week according to regulations. According to Circular No. 08/2016/TT-BGDDT, school management staff ( principals, Vice Principals) working as non-professional union workers must still teach enough teaching hours according to regulations.

If the concurrent working period in trade union leads to a total working period exceeding the prescribed norms, they will be entitled to the salary regime for overtime teaching according to current regulations.
Ms. Huong asked: "Am I entitled to overtime benefits? ".
The Ministry of Education and Training responded to this issue on the Government Electronic Information Portal as follows:
According to the provisions of Clause 4, Article 8 of Circular No. 05/2025/TT-BGDDT dated March 7, 2025 of the Ministry of Education and Training, the working regime for general education teachers, university providers, Principals, and Vice Principals cannot be converted to a regime of reducing teaching hours for concurrent tasks to replace teaching hours.
At the same time, according to the provisions of Clause 4, Article 4 of Circular No. 08/2016/TT-BGDDT, Principals and Vice Principals working in non-professional trade unions must still teach the required number of teaching hours. If the concurrent working time in trade union work leads to a total working time exceeding the prescribed norms, they will be entitled to the salary regime for overtime teaching according to current regulations.
Joint Circular No. 07/2013/TTLT-BGDDT-BNV-BTC dated March 8, 2013 on the regime for paying overtime wages clearly states the principle: "Only pay overtime wages at units or subjects with less teachers approved by competent authorities. In case there is no shortage of teachers, only pay when there are people who are sick, pregnant, go to school, work other tasks sent by competent authorities and need other teachers to teach instead".
To enjoy the overtime teaching regime due to concurrent work in the trade union, Ms. Nguyen Thi Huong needs to clarify the total actual working time, based on the situation of teachers' staffing at the school and report to the principal for specific instructions. The school will review the dossier, compare the regulations and prepare procedures to request the management agency to approve the payment if eligible.
