Mr. Thang asked, so for cases of exemption from probation, it will take 9 years, or 9 years plus 1 year?
The Ministry of Education and Training responded to this issue on February 2 as follows:
Mr. Nguyen Thang is exempted from probationary period. Therefore, if he has held the professional title of primary or secondary school or high school teacher grade III or equivalent for 9 years or more up to the deadline for submitting the application for promotion, it will be determined to meet the standards and conditions for the duration of the promotion to the professional title of grade II teacher of the level of education he is teaching.
New regulations on cases where civil servants are exempted from probation
Clause 5 of Decree 115 stipulates the cases of civil servants who are exempted from probation and are amended and supplemented by Decree 85/2023/ND-CP as follows:
5. Cases recruited as civil servants do not have to undergo probationary regime if they meet the following conditions:
a) Arranged to work in accordance with the training major and in accordance with the expertise and profession of the previously held job;
b) The working time of professional and technical work previously completed in accordance with the provisions of law, with compulsory social insurance contributions (if not continuous, it will be accumulated), equal to or greater than the corresponding probationary period as prescribed in Clause 2 of this Article.
In case the conditions in Point a are met but the time limit as prescribed in Point b is not enough, the working time will be deducted from the probationary period according to regulations.
For cases that do not have to undergo a probationary period, they will receive 100% of their salary and allowances (if any). The head of the public service unit must send civil servants to participate in the training course to complete the standards and conditions of the professional title of civil servant before appointment".
