Groups of issues related to allowances and preferential treatment always receive attention from the teaching staff. Over the past time, many questions have been sent to the Ministry of Education and Training, including the question of Mr. V.B.C.
Mr. B.C said that based on Clause 1, Article 4 of Decree No. 77/2021/ND-CP stipulating that teachers participating in teaching and education with compulsory social insurance contributions for 5 years (60 months) are entitled to seniority allowances equal to 5% of the current salary plus leadership position allowances and over-the-frame seniority allowances (if any).

From the sixth year onwards, an additional 1% is calculated each year (full 12 months). For example, in the case of teachers who already have a seniority allowance of 18%.
However, for some specialized majors, enrollment is not possible, leading to teachers not participating in teaching during the school year; but still performing other educational tasks such as research, development of scientific applications and technology transfer, ensuring training quality....
So does not directly participating in teaching in that school year affect the monthly seniority allowance that teachers are entitled to?" - Mr. B.C raised the issue.
Regarding this question, the Ministry of Education and Training said that the seniority allowance regime for teachers is implemented according to the provisions of Decree No. 77/2021/ND-CP dated August 1, 2021 of the Government. Accordingly, the subjects of application are teachers who are teaching and educating in public educational institutions.
In case teachers belong to a specialized major, due to not being able to enroll students, in some school years they are not assigned to teach but are still assigned to perform other educational tasks according to their functions, this time is still counted as the time to participate in educational activities.
Therefore, not participating in teaching during the school year due to training characteristics does not interrupt the time of calculating the seniority allowance for teachers and does not change the level of seniority allowance that teachers are currently receiving; only when teachers no longer work at public educational institutions or do not participate in compulsory social insurance will it affect the enjoyment of seniority allowance for teachers.
