The Ministry of Education and Training is seeking opinions on the draft Circular regulating the working regime for preschool teachers.
Contributing opinions, Hai Phong Department of Education and Training proposed that the Ministry of Education and Training study reducing the number of working weeks or increasing the time to compensate for preschool teachers. However, the Department of Teachers and Educational Administrators upheld the regulation and said that the regulation of the number of weeks of teaching children has ensured consistency with the school year time frame according to the regulations of the Ministry of Education and Training.
Also related to the working hours of teachers, Quang Tri Department of Education and Training believes that it is necessary to clearly stipulate lunch break time for preschool teachers; arrange reasonable rotational duty and have a mechanism to compensate for rest time or provide appropriate support when the rest time is not guaranteed according to regulations.

Accepting feedback, the Department of Teachers and Educational Administrators has added the principle of arranging teachers to participate in dropping off children or picking up children or taking care of children at noon to Clause 3, Article 4 of the draft Circular.
Contributing opinions to the draft in Clause 1, Article 6, Hue and Lang Son Departments of Education and Training said that it is necessary to Supplement regulations or specific guidance on calculating, subsidizing or converting working hours exceeding 8 hours/day for preschool teachers, ensuring the legitimate rights of teachers.
Sharing the same view, Tay Ninh Department of Education and Training proposed to specifically guide the arrangement of working hours during the day for preschool education institutions to implement uniformly.
The locality believes that the regulation of working hours of 8 hours/day and 40 hours/week is in accordance with the Labor Code. However, according to the MN Education Program for preschool teachers teaching 2 sessions/day, in reality, working hours are often longer due to the specific nature of work such as: picking up and dropping off children, organizing semi-boarding, cleaning classrooms, preparing supplies, completing professional dossiers.
The Department of Teachers and Educational Administrators upholds this content and believes that if teachers teach beyond the norm, they are entitled to the overtime teacher salary regime as prescribed in Circular No. 21/2025/TT BGDDT. Therefore, this Circular does not reiterate the provisions of Circular No. 21.
In addition, the arrangement of working hours must be based on the preschool education program, school plans, based on the regulations on the school year time frame as prescribed by the province and based on local guidance on working hours of units and organizations in the area.
