In August 2026, Khanh Hoa province will apply regulations on mobilizing and transferring teachers in public educational institutions in the province.
Regulations apply to teachers who have been recruited, teachers holding management positions who are working at public educational institutions directly under the Department of Education and Training, commune-level People's Committees; and agencies, units, organizations, and individuals related to the transfer and reassignment of teachers. Positions of educational institution staff are not within the scope of application.
The authority to consider and decide belongs to the Director of the Department of Education and Training or the Chairman of the Commune-level People's Committee according to their authority, based on the selection and proposal of the strengthening unit and the unit to be strengthened.
The transfer must be carried out publicly, transparently, objectively, in accordance with the law; and based on the results of reviewing the number of locally surplus and shortage teachers and the proposals of the units.
The goal is to transfer teachers from surplus units to understaffed units. Thereby ensuring that the number of people working and receiving salaries from the State budget at educational and training non-business units is consistent with the prescribed norms.
According to regulations, the subjects of transfer include teachers on the list of redundant staff when rearranging educational institutions or due to changes in the scale of classes, subjects, and training majors.
Teachers who wish to be transferred to work in ethnic minority areas, mountainous areas, islands and areas with particularly difficult socio-economic conditions are also considered.
Regulations encourage educational institutions and competent authorities when reviewing and proposing transfers to consider not transferring teachers who are only 5 years or less before reaching retirement age, except for cases where teachers are voluntary.
Notably, in cases of surplus teachers due to the rearrangement of educational institutions or due to fluctuations in the scale of classes, subjects, and training majors, leading to educational institutions having more teachers than the quota or usage needs, the surplus number will be transferred to other educational institutions in rotation form.
After completing the mobilization period, the teacher is arranged to return to the strengthened unit. In case of wishing to transfer to another educational institution, the teacher is considered for resolution if that educational institution still has staff and a suitable job position.
Teachers who have completed the time of transfer to units that need to be strengthened are not subject to transfer in the next consecutive round.
Regarding the transfer and appointment of teachers to hold positions of educational institution management officials, the process is implemented according to the Party's regulations on personnel work, law on public employees and regulations on decentralization of management of officials, civil servants, and public employees currently of Khanh Hoa Provincial People's Committee.
