Teacher Hoa* (teacher at Phu Thuan Primary School, Hue City), reported that in the 2023-2024 school year, she self-classified her civil servant as "Excellently completing tasks" (score: 93/100 according to form No. 5 issued with Decision No. 24/2021/QD-UBND dated April 12, 2021 of the People's Committee of Thua Thien Hue province); The professional team evaluated and classified her as "Excellently completing tasks".
However, the school principal, Mr. Nguyen Van Dang, downgraded her to "Completing tasks" and did not publicly announce the results of the evaluation and classification of civil servants according to regulations.
Speaking to a reporter from Lao Dong Newspaper, Mr. Nguyen Van Dang - Principal of Phu Thuan Primary School said that the downgrading of Ms. Hoa's rating from "Completed tasks well" according to personal assessment to "Completed tasks" was because during the school year, Ms. Hoa was late many times, so at the end of the year, the emulation and reward council voted secretly to downgrade her rating. However, he did not have a record to prove that the teacher was late.
The evaluation and classification of civil servants is carried out based on Decree 90 dated August 13, 2020 of the Prime Minister on the evaluation and classification of the quality of cadres, civil servants and public employees and based on Decision No. 24 dated April 12, 2021 of the People's Committee of Thua Thien Hue province on evaluation, scoring and classification (for civil servants not holding leadership or management positions) with scoring criteria (100-point scale).
At point b, section 5 of the Quality Assessment, Scoring and Classification Form (Form No. 5, issued with Decision No. 24 of the People's Committee of Thua Thien Hue province on Assessment, Scoring and Classification) clearly states: "Comply with the time, rules and regulations of the agency or unit" stipulates "maximum score of 1.5 points" and at the same time clearly states: "1 violation deducts 0.25 points".
So if Ms. Hoa is late, she will be deducted a maximum of 1.5 points. With a self-assessment score of 93 points, Ms. Hoa cannot have less than 70 points (the score corresponding to the "Completed task" classification).
In addition, Ms. Hoa wondered, the group ranked her 5th out of 7 teachers in the group, but the 2 people ranked after Ms. Hoa were "Advanced Workers" but Ms. Hoa was not?
Notably, in the 2023-2024 school year, Phu Thuan Primary School issued a decision to consolidate the school's Emulation and Reward Council with 8 members. However, Clause 1, Article 12 of Circular No. 28 dated September 4, 2020 of the Ministry of Education and Training on Promulgating the Charter of Primary Schools clearly states: "... The number of members in the Emulation and Reward Council is an odd number". Thus, Phu Thuan Primary School established an Emulation and Reward Council that was not in accordance with the provisions of Circular 28.
Talking to Lao Dong Newspaper reporters about the incident, lawyer Tran Hau Dinh - Hanoi Bar Association - affirmed that the assessment and classification of civil servants (including teachers) must comply with current legal documents such as Decree 90/2020 of the Government, Decision No. 24/2021 of the People's Committee of Thua Thien Hue province and Circular No. 28/2020 of the Ministry of Education and Training.
"The fact that Phu Thuan Primary School only based on the content of the violation of "Complying with time, regulations, and rules of the agency and unit" to downgrade the emulation level and establish an emulation and reward council with 8 members (even number) is not in accordance with regulations, and needs to be reviewed and adjusted to ensure accuracy, objectivity, and compliance with the law" - Mr. Dinh said.
