The Ministry of Justice is appraising the dossier of the draft Decree stipulating the preferential allowance regime by profession for civil servants and employees working in public educational institutions proposed by the Ministry of Education and Training.
The Ministry of Education and Training proposes the following preferential allowance level by profession:
The 20% preferential allowance level is applied to civil servants and employees working in public educational institutions, belonging to the following job groups:
Group of common professional titles;
Job position group for support and service work;
Category of professional titles, excluding positions of teachers and lecturers.
The 30% preferential allowance level is applied to civil servants and employees working in public educational institutions, in one of the following cases:
Teachers directly teaching at universities, academies, universities and training schools under the Ministry, ministerial-level agencies, agencies under the Government, Party organizations, socio-political organizations at the Central level, and provincial and city-level political schools directly under the Central Government;
Teachers teaching theory or practice at college level, intermediate level, vocational secondary education program;
Teaching assistants working at public higher education institutions;
Persons directly guiding practice at school workshops, stations, camps, laboratories of public higher education institutions, public vocational education institutions, or guiding practice on training ships;
Management positions without teacher and lecturer codes in public educational institutions; Management positions from department level and equivalent or higher for university preparatory schools, T78 Friendship School, 80 Friendship School and Viet Bac Highland High School.
The 40% preferential allowance level is applied to teachers working in public educational institutions, in one of the following cases:
Teachers teaching political education subjects at intermediate schools;
Teachers teaching at political centers at commune, ward or special zone levels;
Educators integrate theory with practice at college level, intermediate level, vocational secondary education program;
Teachers who are artisans or people with national vocational skills certificates level 4 or higher, or workers level 5/6, 6/7 or higher or equivalent, directly teaching practice at college level, intermediate level, vocational secondary education program;
Teachers teaching at secondary schools, high schools, or centers including: continuing education centers, vocational education - continuing education centers, vocational education centers, vocational secondary schools.
The 45% preferential allowance level is applied to teachers working in public educational institutions, in one of the following cases:
Teachers teaching at preschool and primary school educational institutions;
Teachers teaching at educational institutions located in communes of region I, region II of ethnic minority and mountainous areas; island communes, islands, border communes, safe zone communes according to the Government's regulations, including: secondary schools, high schools, continuing education centers, vocational education - continuing education centers, vocational education centers, vocational schools;
Teachers teaching at pedagogical schools, educational administrators' schools or pedagogical faculties of universities, academies, universities, colleges;
Teachers teaching in classrooms with less than 50% of students being disabled, not belonging to schools and classes specified in point b, clause 7 of this Article.
Proposal for a 40% preferential allowance for teachers teaching at secondary schools and high schools.
The 50% preferential allowance is applied to teachers teaching Marxist-Leninist sciences, Ho Chi Minh Thought or Political Education at the following public educational institutions:
Universities, academies, universities, colleges;
Training schools under the Ministry, ministerial-level agencies, and agencies under the Government;
Training facilities of Party organizations and socio-political organizations at the Central level;
Political school of provinces and cities directly under the Central Government.
The 60% preferential allowance level is applied to teachers working in public educational institutions, in one of the following cases:
Teachers teaching at sports gifted schools, art gifted schools or semi-boarding ethnic minority high schools;
Teachers teaching at preschool education institutions, primary schools located in communes in region I, region II of ethnic minority and mountainous areas; island communes, islands, border communes, safe zone communes according to the Government's regulations;
Teachers teaching in a class with 50% or more students being disabled but not belonging to the schools and classes specified in point b, clause 7 of this Article.
The 80% preferential allowance level is applied to one of the following subjects:
Teachers directly teach at schools, facilities, and centers including: Ethnic Minority Boarding School; Ethnic Minority Boarding Vocational Secondary School; Specialized High School; University Preparatory School; Friendship School 80, Friendship School T78, Viet Bac Highland High School;
Teachers directly teach at schools, classes, and centers for people with disabilities; Centers to support the development of inclusive education;
Teachers teaching at educational institutions located in areas with particularly difficult socio-economic conditions as prescribed by the Government.
According to the draft, the professional preferential allowance levels for preschool teachers and general education teachers are applied from January 1, 2026 to the end of December 31, 2030.
From January 1, 2031, the implementation of professional preferential allowances for preschool and general education teachers will be applied according to the provisions of Resolution No. 71, which is at least 70% - 100% for general education and preschool teachers and 30% for school staff.
