Up to now, she has 7 years of compulsory social insurance contributions, so is she entitled to seniority allowance for teachers?
Regarding this issue, the Ministry of Education and Training answers as follows:
The seniority allowance regime for teachers is implemented according to the provisions of Decree No. 77/2021/ND-CP dated August 1, 2021 of the Government. Accordingly, the time for calculating seniority allowance for teachers includes the time of teaching and education with compulsory social insurance contributions in public educational institutions as prescribed.
In case Ms. Nguyen Phuong Linh has 4 years of working under contract in a state agency but does not perform teaching and educational duties, this time is not included in the time used as a basis for enjoying seniority allowances for teachers.
The time to calculate seniority allowance for teachers is determined from the time of being appointed to the title of teacher and directly performing teaching and education tasks; after deducting probationary time as prescribed, when it is 5 years (60 months), she is entitled to seniority allowance for teachers as prescribed.
