The Department of Education and Training (DET) of Ho Chi Minh City has just sent a document to the People's Committees of wards, communes and special zones to clarify many remaining problems in the implementation of Resolution No. 30/2025/NQ-HDND on policies for developing preschool education in areas with industrial parks and many workers.
Clarifying what is "where there are many workers"
According to the Department of Education and Training, the determination of "where there are many workers" is based on Decree 145/2020/ND-CP of the Government. Industrial parks, export processing zones, high-tech zones or industrial clusters with 5,000 or more workers working and participating in social insurance are considered places with many workers.
For communes and wards, the criterion is that 3,000 or more workers register for permanent or temporary residence.
Currently, the Department of Education and Training has coordinated with the Management Board of Export Processing and Industrial Zones of Ho Chi Minh City, the Management Board of the High-Tech Park and the Department of Industry and Trade to review and compile a list of industrial parks and clusters and has submitted to the People's Committee of Ho Chi Minh City a report to specifically determine the eligible areas.
Are children of teachers and civil servants entitled to the policy?
One of the major questions of localities is whether preschool children who are children of teachers, civil servants, and workers in state agencies and public service units are entitled to the policy under Resolution 30 or not.
With this opinion, the Department of Education and Training of Ho Chi Minh City cited the provisions of Decree 105, Decree 145, Labor Law No. 45, Law on Civil Servants No. 58 and emphasized: it is necessary to determine and distinguish between labor contracts and labor contracts.
It is not mandatory that 30% of children are children of workers in "where there are many workers"
Regarding the condition that preschool education institutions are supported, the Department of Education and Training affirmed: kindergartens, kindergartens, private preschools in places with a lot of workers are not required to have 30% of children who are workers as in industrial parks.
These facilities enjoy similar policies to non-public preschools in industrial parks according to the provisions of Decree 105/2020/ND-CP.
Where are preschool teachers supported?
According to the Department of Education and Training, preschool teachers working in kindergartens, kindergartens, and private and non-public kindergartens in areas with a large number of workers are all eligible for support.
Children outside industrial parks can still enjoy the policy
The Department of Education and Training also affirmed that children who are children of workers and laborers working in enterprises and production and business establishments outside industrial parks, but in areas identified as "where there are many workers", are still entitled to preschool education development policies according to Resolution 30.
