Time to reserve allowances for principals and vice principals affected after school merger

Principals and vice-principals who resign from their positions or are appointed to positions with lower allowances will have their old position allowances preserved.

Implementing the policy of arranging public educational institutions, localities have completed the arrangement and consolidation of organizations. In addition to putting into operation the new school model, stabilizing teaching and learning, ensuring the rights of staff affected in the arrangement process is also concerned by localities.

According to estimates by the Ministry of Education and Training, after arrangement, about 32,652 management officials may be assigned to work as teachers, contributing to solving the teacher shortage situation; about 11,041 administrative staff need to continue to be arranged.

To ensure policies for those affected by school arrangement, the Government has issued Resolution 37/2026/NQ-CP on the structure, quantity and a number of policies for principals, directors, vice principals, deputy directors, and educational support personnel when implementing the arrangement of public preschool, general, continuing education, and vocational education institutions at the provincial and commune levels.

Ministries, branches and localities have also issued many guiding documents on the arrangement of redundant management officials and cases where allowances are preserved.

In the process of implementation, some localities are concerned about how to resolve cases where principals and vice principals resign from their positions or are appointed to positions with lower allowances?

Regarding this issue, Resolution 37/2026/NQ-CP has detailed regulations.

Article 4 of Resolution 37/2026/NQ-CP stipulates: In case principals, directors, vice-principals, and deputy directors resign from their positions or are appointed to new positions with lower position allowances due to the arrangement of educational institutions, the leadership position allowance is preserved according to the provisions of Article 11 of Decree 178/2024/ND-CP (amended and supplemented in Decree 67/2025/ND-CP).

Regarding the time for preserving allowances, according to Article 11 of Decree 178/2024/ND-CP, amended and supplemented by Clause 11, Article 1 of Decree 67/2025/ND-CP, people holding leadership and management positions who cease to hold positions or are appointed to new positions with lower position salaries/position allowances due to organizational restructuring are entitled to: Preserve the old position salary or old leadership position allowance until the end of the election term or the end of the term of appointment.

If the remaining time of the election term or appointment term is less than 06 months, it is reserved for 06 months.

Thus, principals and vice-principals who are appointed to new positions with lower position allowances due to the arrangement of educational institutions are entitled to retain leadership position allowances according to the provisions of Article 11 of Decree 178/2024/ND-CP (amended and supplemented in Decree 67/2025/ND-CP).

The period of preservation of the old position allowance is until the end of the previous term of appointment. In case the term is less than 6 months, it is still preserved for a full six months.

For example, a principal still has 02 years of appointment term, but after arrangement, the school does not continue to hold the position of principal.

If subject to the case of applying Article 11 of Decree 178, the old position allowance is preserved for the remaining 02 years, not just 06 months.

And if that principal only has 04 months left of term at the time of resignation due to school arrangement, the old position allowance will be preserved for 06 months.
