Circular 21 takes effect from September 23, repealing Joint Circular No. 07/2013/TTLT-BGDDT-BNV-BTC dated March 8, 2013 of the Minister of Education and Training, the Minister of Home Affairs and the Minister of Finance guiding the implementation of the overtime teacher salary regime for teachers in public educational institutions.
The payment of overtime teachers' salaries for the 2024-2025 school year is still implemented according to the provisions of Joint Circular No. 07/2013/TTLT-BGDDT-BNV-BTC.

Circular 21/2025/TT-BGDDT of the Minister of Education and Training stipulates the regime for paying overtime teacher salaries for teachers in public educational institutions.
According to Circular 21, the total number of extra teaching hours in a school year of each teacher is calculated to pay for extra teaching hours not exceeding 200 hours. In case the total number of extra teaching hours in a school year of teachers exceeds 200 hours because the subject cannot arrange enough teachers to teach, the head of the educational institution must notify in writing to the competent authority.
The average hourly salary of preschool and general education teachers = (Total salary of 12 months in the school year/Temporary teaching hours per year) x (22.5 weeks/52 weeks).
Monthly teaching salary of university and college lecturers = (Total salary of 12 months/monthly teaching hours) x (Yearly teaching hours calculated according to administrative hours/1760 hours) x (44 weeks/52 weeks).
1-session tutoring salary = Regular 1-session tutoring salary x 150%.
The Circular stipulates that the time to pay overtime teachers' salaries is after the end of the school year. In case teachers retire, resign, transfer, or transfer, the payment of overtime teachers' salaries is made at the time of the retirement, resignation, transfer, or transfer decision of the competent authority.
In addition, the time the teacher does not directly participate in teaching but is counted as completing enough teaching periods according to the prescribed norms and is included in the total number of teaching periods in the teacher's school year, including:
The time teachers perform other tasks assigned or transferred by educational institutions or competent authorities (except for tasks that have received remuneration);
The time when teachers are sent to training and fostering by competent authorities does not directly participate in teaching;
The time is calculated to complete the full number of standard teaching periods according to the provisions of law.
The Ministry of Education and Training said that the funding for paying overtime teachers' salaries is taken from the school's source. Schools base on actual conditions to pay or advance this money to teachers monthly, semesterly or annually.
