Mr. V.B. C reflected that, according to the provisions of point d, clause 1, Article 9 of Circular No. 29/2023/TT-BGDĐT stipulating the criteria for considering Certificates of Merit of the Ministry of Education and Training, individuals working at units under the Ministry, units directly under the Ministry, and national universities who have been awarded the title "Grassroots Emulation Soldier" twice in a row or have been continuously recognized as excellently completing tasks for 2 years or more, during which time there are 2 initiatives recognized and effectively applied within the grassroots scope or there are 2 scientific topics, scientific projects, scientific and technological works, scientific and technological projects that have been accepted and effectively applied within the grassroots scope.
Mr. C said that currently the regulations in point d, clause 1, Article 9 of Circular No. 29/2023/TT-BGDĐT are not clear, leading to legal obstacles in understanding.
Specifically, for the phrase "There are 2 initiatives recognized and effectively applied within the grassroots level or there are 2 scientific topics, scientific projects, scientific and technological works that have been accepted and effectively applied within the grassroots level", there are 2 different understandings:
The understanding 1 is that A must meet the criteria of 2 initiatives or 2 topics. In case 1 initiative and 1 topic, the conditions are not met;
The second understanding is that the nature of the initiative and the topic are the same and point d, clause 1, Article 9 of Circular No. 29/2023/TT-BGDĐ uses the word "or", so if A has 1 initiative and 1 topic, they are both eligible according to point d, clause 1, Article 9 of Circular No. 29/2023/TT-BGDĐT.
This is a legal obstacle in proposing to consider certificates of merit, I respectfully hope the Ministry of Education and Training will provide clear guidance" - Mr. C expressed.
Regarding this content, the Ministry of Education and Training said that the regulations in point d, clause 1, Article 9 of Circular No. 29/2023/TT-BGDĐT mentioned above are quoted from point d, clause 1, Article 74 of the Law on Emulation and Commendation.
This is the standard for awarding Certificates of Merit from the Minister of Education and Training according to the type of commendation for merits, according to which the regulation specifically states "Having 2 initiatives ...or having 2 scientific topics,...".
Therefore, for this standard, individuals propose rewards when they have one of the two achievements mentioned above" - the Ministry of Education and Training responded.
