On December 15, reflecting to a reporter from Lao Dong Newspaper, Mr. Nguyen Van Ha, a high school Literature teacher in Ha Tinh, said that he has worked for many years, has professional achievements and fully meets the promotion standards. However, when completing the procedures, he was informed that he could not be considered for promotion because the rate of Grade II teachers in the school was enough.
"Thus, even if I have many achievements and meet the standards, I still cannot be promoted just because the school's teacher rating structure is enough. This leads to disadvantages in terms of rights, said Mr. Ha.
According to records, this is also a common concern of many teachers at schools where the rate of teachers of all levels has reached or exceeded the prescribed level. Many people believe that controlling the ratio by school makes the personal rights of teachers depend entirely on the structure of the team, while the process of striving and contributing is not fully considered.
Discussing this content with Lao Dong Newspaper reporters, Mr. Bui Nhan Sam, Director of Ha Tinh Department of Education and Training, shared that the issue of the rate of Grade III to Grade II teachers is currently a concern and concern of many teachers.
"According to current regulations, the rate of Grade II teachers does not exceed 50% calculated for each school. In reality, many schools have exceeded this rate. This is an issue beyond the authority of the Department. We can only synthesize the thoughts and recommendations of teachers to report and propose to superiors, said the Director of the Department of Education and Training of Ha Tinh.
Speaking to Lao Dong Newspaper reporter, lawyer Tran Hau Dinh, Hanoi Bar Association, said that the control of the ratio of civil servant professional title ranks is clearly regulated in Document No. 64/BNV-CCVC dated January 5, 2024 of the Ministry of Home Affairs on determining the structure of civil servant ranks and the structure of civil servant professional title ranks.
Accordingly, for public service units in groups 3 and 4 (not self-sufficient in regular expenditures), the maximum rate for each civil servant professional title rank is determined as follows: class I and equivalent not more than 10%; class II and equivalent not more than 50%; class III and equivalent or less not more than 40%.
Lawyer Tran Hau Dinh analyzed that the head of the agency or unit must base on the functions, tasks and actual situation to allocate appropriate rates, but must ensure the ratio framework according to regulations. In case the number according to the ratio in each class is not enough, the remaining number will be added to the adjacent lower class and may be larger than the prescribed ratio.
"However, if the actual number exceeds the above rate, the exam will not be held temporarily or the promotion to a professional title level will exceed the rate. This is the reason why many teachers, even though they are qualified, cannot be considered for promotion at the present time said lawyer Tran Hau Dinh.
