Accordingly, in Cienco4's bids, there are 7 key personnel for construction of the project, including: 1 commander of the project, 2 officers in charge of construction of roads, 1 officer in charge of construction of drainage system items, 1 officer in charge of construction of lighting electricity items, 1 staff in charge of settlement, 1 employee in charge of environmental safety and hygiene.
Among these, the technical officer in charge of the construction of the lighting project was declared by CIENCO4 in the bidding documents as Mr. T.G.K - electrification Engineer, through 1 principle contract signed between the contractor and the personnel and 1 commitment of the personnel.
However, in the minutes of working with the Management Board of Nam Cao University on April 16, 2025, Mr. T.G.K affirmed that "not signing a contract principle No. 1400/HDNT dated 27.2225 with CIENCO4 Group Joint Stock Company", "Do not write a commitment to send to CIENCO Group Joint Stock Company on agreeing to participate in the construction of Package No. 11: Construction and construction under the planning of N1, N1 route Cao "and" Cienco4 Group Joint Stock Company uses my personal information and records to participate in bidding for package 11 of the project without my consent is contrary to the provisions of the law ".
On April 18, 2025, during a working session between the Nam Cao University Management Board and related parties to check the key personnel of the construction contractor, CIENCO4 could not bring Mr. T.G.K to the investor's invitation without reason.
CIENCO4 also failed to present the original documents of Mr. T.G.K to compare with the copy documents in its bidding documents.
For the above reasons, the investor and related parties concluded that in the bidding documents for package 11 of CIENCO4, there were documents forged related to key personnel, Mr. T.G.K, specifically forging Mr. K's signature in the principal contract and commitment.
Does not too affect the project's construction progress?
According to the Nam Cao University Management Board, after discovering the above incident, this unit and the Department of Finance reported and advised the People's Committee of Ha Nam province to consider and resolve it according to the provisions and procedures of the law.
The People's Committee of Ha Nam province later issued a document on not recognizing the contractor selection results, later the decision to ban bidding for Cienco4; At the same time, directing the investor to take the following steps in accordance with Clause 20, Article 131 of Decree No. 24/2024/ND-CP of February 27, 2024 of the Government and relevant regulations to soon overcome violations of bidding for bidding package 11.
After terminating the construction contract with CIENCO4, the Management Board of Nam Cao University Area appointed the second-placed contractor, Tu Lap Construction Company Limited, to continue constructing the project, but this enterprise issued a document refusing to participate in the construction.
According to regulations, the contractor ranked 3rd is Dacinco Construction Investment Company Limited, which then agreed to sign the construction contract for the remaining volume of the project and is responsible for paying for the volume that CIENCO4 has constructed since the groundbreaking date of March 20, 2025.
"Cienco4 has not been constructed for a long time and the volume has not been much, mainly they have just implemented the preparation for construction.
