It can be said that the above accident has just happened so we still have to wait for the final conclusions. However, one of the issues that people are concerned about is whether the above accident is covered by insurance?
First of all, from the perspective of motor vehicle liability insurance, according to current regulations, this is a compulsory insurance. However, this type of insurance is used to compensate third parties.
Clause 5, Article 3 of Decree 67/2023 explains the term third party as follows: For compulsory civil liability insurance of motor vehicle owners: A third party is a person who suffers damage to health, life, or property caused by a motor vehicle, except for the following persons: The driver, people in the vehicle, passengers on that vehicle; the vehicle owner, except in cases where the owner has assigned another organization or individual to possess and use that vehicle.
Thus, it can be initially determined that this accident did not collide with another vehicle, so it is difficult to be compensated by civil liability insurance.
Whether or not victims are compensated depends on whether or not they have commercial insurance.
If the accident vehicle has previously purchased motor vehicle physical damage insurance (body insurance). When an accident occurs, this vehicle can be compensated by insurance. If the victims purchase life insurance, they will also be compensated. Specific compensation must be based on the insurance contract.
Regarding the accident, the Traffic Safety Committee of Nam Dinh province said that at around 3:00 p.m. on January 30, 2025, at km153+500 of National Highway 21 in Nam Van ward, Nam Dinh city, Nam Dinh province, Ms. N.T.D (born in 1964, currently residing in Ton That Thiep, Dien Bien ward, Ba Dinh district, Hanoi city) was traveling on National Highway 21 in the direction of Co Le town to Nam Dinh city when she caused an accident. There were a total of 9 people in the car.
According to information from the authorities, Ms. D has a Class B1 driver's license issued by the Hanoi Department of Transport on November 30, 2020, valid until November 30, 2030. Ms. D drives a car with license plate 30G - 156.XX (7-seat type, first registered on December 30, 2019, with a certificate of technical safety and environmental protection inspection No. DA-6403XXX, inspection period until December 10, 2025).
The accident resulted in 7 deaths at the scene, including: Ms. N.T.D (driver), Mr. N.D.C - born in 1956, Ms. D's husband; Ms. N.N.A - born in 1989, Ms. D's daughter; Mr. Tr.Ng.M.K - born in 2017, Ms. N.N.A's daughter; Mr. N.V.T - born in 1986, residing in Thanh Oai, Hanoi; Ms. D - born in 1991 (Mr. T's wife); and N.Q.M - born in 2023 (address unknown).
The two injured people taken to the hospital for emergency treatment were: Ms. N.N.Q - born in 1991 (Mrs. D's daughter); N.N.D - a 6th grade student in Hanoi.
The preliminary cause confirmed by the authorities was that the car was moving when it turned to the right, hit the guardrail, then plunged into the ditch next to the road, and did not collide with people or other vehicles.
