Workers petition about Social Insurance, Unemployment Insurance

Hanoi - At the Dialogue Conference on the afternoon of May 29, the Hanoi Labor Federation presented groups of workers' recommendations, including Social Insurance and Unemployment Insurance.

The Conference of the Chairman of the People's Committee of Hanoi City meeting and dialogue with workers of the Capital took place under the direction of the following officials: Vu Dai Thang - Member of the Party Central Committee, Deputy Secretary of the City Party Committee, Chairman of the People's Committee of Hanoi City; Nguyen Anh Tuan - Member of the Party Central Committee, Vice Chairman of the Central Committee of the Vietnam Fatherland Front, Chairman of the Vietnam General Confederation of Labor; Nguyen Van Thang - Member of the Presidium of the Vietnam General Confederation of Labor, City Party Committee Member, Vice Chairman of the Vietnam Fatherland Front of Hanoi City, Chairman of the Hanoi City Labor Federation.

According to Chairman of the Hanoi Labor Federation Nguyen Van Thang, one of the groups of recommendations from workers and grassroots trade unions received by the Organizing Committee is the issue of health, health care, social insurance, health insurance and food safety.

The opinions and recommendations in this group include: Requesting the Hanoi People's Committee to pay attention, direct and prioritize resources to accelerate the implementation of the project to upgrade and expand Gia Lam General Hospital to a scale of 500 beds, ensuring timely response to the increasing medical examination and treatment needs of workers and people in the area.

Currently, regulations on conditions for enjoying unemployment insurance (BHTN) are limiting the time to enjoy unemployment insurance to 12 months, at the end of these 12 months, the entire time participating in unemployment insurance from the 13th year onwards is not preserved. Moreover, participating in unemployment insurance for 1 year according to regulations has been enjoyed for 3 months, leading to 2 cases occurring. First case: Employees want to take leave to withdraw unemployment insurance because they are afraid of losing benefits when according to current regulations, participating in unemployment insurance from the 13th year is meaningless. Second case: Employees change jobs continuously because just paying insurance for one year has been entitled to 3 months of unemployment insurance. Therefore, it is proposed to allow employees to reserve the unentitled unemployment insurance participation process after receiving 12 months of unemployment insurance.

Every year, many labor accidents occur in the City, causing many workers to be injured. It is respectfully requested that the City People's Committee direct the City Social Insurance to strengthen guidance and simplify procedures so that workers who have had labor accidents can enjoy regimes and benefits on labor accident insurance according to regulations. Currently, the Law stipulates that health type 3, 4, 5 recognition is not allowed to be arranged to work in heavy, hazardous positions. This leads to businesses having difficulty arranging jobs for workers with health classifications at this level. Proposing to higher levels to study and amend accordingly so that workers with health type 3, 4, 5 can work in heavy, hazardous positions if there is consent from workers, businesses monitor and assess risks appropriately. Ensuring that businesses can arrange jobs for workers.

It is proposed that the City People's Committee have more specific measures and sanctions to ensure food safety, prevent and thoroughly handle the situation of "dirty food". Promote market inspection, especially for essential consumer goods, medicines, food, and goods directly serving workers' lives. Publicize the list of violating organizations and individuals; apply mandatory sanctions to recall goods and compensate consumers for damages. Promulgate regulations and encourage the widespread application of QR codes for traceability so that workers can easily check and supervise product quality.

According to the Chairman of the Hanoi Labor Federation, in response to the recommendations and proposals of workers, the Hanoi Department of Health said that the Project was approved for investment policy by the Hanoi City People's Council in Resolution No. 14/NQ-HDND dated July 4, 2023. The City People's Committee has assigned the task to the Gia Lam District People's Committee (before arrangement) to be the Investor to implement the project. Currently, the City has assigned it to the Gia Lam Commune People's Committee according to Decision No. 3339/QD-UBND dated June 27, 2025. The project has been approved for the overall ground plan, the Investor is completing the Feasibility Study Report dossier, expected to be submitted for appraisal in June 2026. The City People's Committee is continuing to direct and urge the Gia Lam Commune People's Committee to urgently implement the project to complete and put it into use to meet the medical examination and treatment needs of people in the area.

Answering the recommendations of workers, Hanoi City Social Insurance said: Hanoi City Social Insurance implements the settlement and payment of unemployment insurance benefits to workers according to the provisions of Decree No. 374/2025/ND-CP, 2025 Employment Law, Decision No. 366/QD-BHXH dated April 29, 2026 promulgating the process of collecting and settling social insurance, health insurance, and unemployment insurance benefits.

Regarding the proposal to allow employees to preserve the unemployment insurance participation period that has not been enjoyed after receiving 12 months of unemployment insurance: Based on Clause 1, Article 8 of Decree No. 374/2025/ND-CP dated December 31, 2025 of the Government detailing a number of articles of the Law on Employment on unemployment insurance, it is stipulated: "Preserve the unemployment insurance contribution period when employees enjoying unemployment benefits have months of unemployment insurance contribution but have not been granted unemployment benefits. Employees with unemployment insurance contributions of over 36 months to full 144 months, the contribution period that has not been granted unemployment benefits is preserved. Employees who have paid unemployment insurance for over 144 months, the periods that have not been granted unemployment benefits are not preserved...".
