Project to convert 312 rental apartments into permanent ownership in Hanoi

The Phuong Dong Green Park project has just been pointed out by the Government Inspectorate for many violations related to land allocation without auction, bidding and many other violations.
Recently, the Government Inspectorate (TTCP) announced the conclusion of the inspection on the conversion of land use purpose for a land area of 14,346 m2 on Phap Van Street, Hoang Liet Ward, Hoang Mai District, Hanoi City.This is the land assigned to the Agricultural Construction and Rural Development Corporation (an enterprise under the Ministry of Agriculture and Rural Development) for management and use.In 2019, the Hanoi People's Committee allowed this land to change its purpose of use to implement the Housing, Office and Commercial Services Complex project (commercial name is Phuong Dong Green Park project). According to the construction permit granted in 2019, Phuong Dong Green Park project has a scale of 2 apartment buildings with 29 floors above ground, 3 basements and 13 low-rise apartments.However, according to the Government's statistics, the actual usable area of apartments for sale increased by 396.8 square meters; apartments for rent increased by 131 square meters; the construction area of basement B1 increased by 595 square meters compared to the allocated land area for calculating land use fees and land rent, but the Hanoi People's Committee and relevant departments and agencies have not yet determined the land use fees and land rent to collect the budget according to regulations.Phuong Dong Investment Company Limited (Phuong Dong Company) has sold 312 apartments for short-term lease under the form of long-term ownership.In addition, Phuong Dong Company also sold 11 townhouses and 110 apartments before the Department of Construction granted a construction permit and notified that it was eligible to sell future housing, which is a violation of the 2014 Law on Real Estate Business.The unit price for land rental payment for the entire rental period is 12.03 million VND/m2, 55.65 million VND/m2 lower than the unit price for land for apartment construction with land use fee collection (67.68 million VND/m2).According to research, Phuong Dong Green Park is currently being sold on many real estate websites with prices ranging from 45 - more than 50 million VND/m2 with a commitment to the owner's red book and full legal documents.
According to the Government Inspectorate, responsibility for the above violations belongs to the Hanoi People's Committee, relevant departments, the Agricultural Construction and Rural Development Corporation, Phuong Dong Company, Hoang Mai District People's Committee, and Hanoi Department of Construction.
The Government Inspector General recommended that the Prime Minister direct a review of the responsibilities of the collective and individual leaders of the Hanoi People's Committee; at the same time, request this agency to preside over and direct relevant departments and branches to review the increase in project construction area; ensure compliance with land allocation decisions, construction planning... recalculate land use fees and land rents for the increased areas.
The Government Inspectorate also requested the Ministry of Public Security to receive information and documents for review, investigation and handling according to the law for the violations pointed out in this project.
