The People's Procuracy of Region 5, Ca Mau Province has just issued a decision to replace preventive measures against the accused Tran Van Tam (residing in Phan Ngoc Hien Commune, Ca Mau) in the case of "Embezzlement of property" under Article 353 of the Penal Code.
The previous detention measure applied to defendant Tran Van Tam was replaced by a security measure abroad.
Thus, after 1 year and 1 day of detention, defendant Tran Van Tam was released on bail to return to his family, wife and children.
Mr. Tam said: "My emotions are mixed with sadness and joy because I was released on bail to temporarily return to my family, but I am still worried because the case is not over, my fate is unknown".
Defendant Tran Van Tam was caught in a legal battle for embezzling 10.7 million VND. However, the accusations related to his violations are still not convincing, there are many bases that need to be considered to handle the right person, the right crime, and the right law.
In July 2022, Mr. Tran Van Tam took on the duties of Principal of Tam Giang Tay Secondary School (old Ngoc Hien District, now Tan An Commune, Ca Mau Province). Realizing a lack of facilities, Mr. Tam proactively bought materials and then made items himself, such as documents, TV shelves, chairs and stairs... to serve teaching and learning in school.
During the process of making the above items, due to the lack of input invoices, Mr. Tran Van Tam bought invoices from other businesses to legalize payment procedures.
Because he paid illegally, Mr. Tam was investigated and concluded to have appropriated more than 10.7 million VND.
Mr. Tran Van Tam was sentenced to 7 years in prison by the first instance court, banned from holding a position for 2 years and forced to return the above amount.
7 years in prison for embezzling 10.7 million VND, Mr. Tran Van Tam said that he was too resentful, he did not deliberately embezzle money, but only violated financial principles.
The Court of Appeal overturned the first instance judgment for re- Investigation.
Mr. Tran Van Tam returned the money that he was said to have appropriated, and he is not a criminal subject that poses a danger to society, so giving it abroad is appropriate.
Public opinion is very interested in the case of embezzlement of 10.7 million VND, which requires a 7-year prison sentence, and hopes that the prosecution agencies will reconsider the entire case and handle the crime correctly, but not "too much" compared to the crime.
Thus, justice is still enforced, but ensures human values.
