Decree No. 154/2025 stipulates 2 groups that have not implemented staff streamlining.
First, those who are pregnant, on maternity leave, or raising children under 36 months old, except for individuals who voluntarily streamline the payroll
Second, those who are under disciplinary review or criminal prosecution or being inspected or examined for signs of violations.
In addition, the Decree also clearly states that the subjects implementing the staff reduction policy include cadres, civil servants, public employees; commune-level cadres, civil servants and people working under labor contracts are subject to the same regime and policies as civil servants as those prescribed by the Government if they fall into one of the following cases:
Civil servants, public employees and workers redundant due to organizational restructuring (except for subjects enjoying policies and regimes in implementing organizational restructuring of the political system according to separate regulations of the Government);
Cadres, civil servants, and public employees who are leaders and managers who cease to hold leadership or management positions or are appointed or elected to leadership or management positions have lower salary levels or leadership position allowances due to the arrangement of the apparatus and individuals voluntarily implement staff streamlining and are approved by the agency, organization, or unit directly managing them;
Cadres, civil servants, and public employees who are leaders and managers who cease to hold leadership or management positions or titles due to restructuring or improving the quality of the leadership and management team according to the decision of the competent authority or the decision of the competent authority to cease holding leadership or management positions, or individuals who voluntarily implement staff streamlining and are approved by the agency, organization, or unit directly managing them;
Surplus due to reviewing and rearranging personnel according to the decision of the competent authority or surplus due to public service units rearranging personnel to implement the autonomy mechanism;
Surplus due to restructuring cadres, civil servants, and public employees according to job positions, but cannot arrange or reorganize other jobs or arrange other jobs but individuals voluntarily streamline the payroll and are approved by the agency, organization, or unit directly managing.
