The Government has just issued Decree No. 322/2025/ND-CP dated December 16, 2025, stipulating the duties, powers, organization and operation of the People's Committee, Chairman of the People's Committee, specialized agencies, and other administrative organizations under the People's Committee of the special zone in special cases.
The People's Committee of the special zone performs the tasks and powers of the budget estimation unit under the Provincial People's Committee according to the provisions of the State Budget Law.
Develop a project to establish, dissolve, merge, divide administrative units, adjust boundaries and rename administrative units of special zones to submit to competent authorities for consideration and decision.
Submit to the Provincial People's Committee for consideration and decision on the establishment, reorganization, renaming, and dissolution of other specialized agencies and administrative organizations under the People's Committee of the special zone.
Based on the staffing quota assigned by the local government at the provincial level, specifically decide on the staffing of civil servants in agencies of the local government in special zones, the number of employees receiving salaries from the state budget in public service units under the management in the special zone.
Decide to establish, reorganize, dissolve, name, and rename villages and residential groups according to the provisions of law; specifically decide on the number of non-professional workers receiving allowances from the state budget in the special- zone area according to the regulations of local authorities at the provincial level.
Decide on measures, programs, and projects on the development of science, technology, information, innovation, and digital transformation in the special zone; measures to build local government, digital economy, digital society in the special zone; measures to promote the application of technology, information, digital transformation in the activities of local authorities in the special zone and provide public services to people and businesses in the special zone according to the provisions of law.
Decide on measures to effectively manage and use land, water resources, forests, seas, and protect the environment in the special zone according to planning, plans and regulations of law; measures to carry out tasks of preventing and combating natural disasters and epidemics in the special zone.
Decide on measures to develop preschool, primary and secondary education; provide primary health care for the people.
The Decree stipulates that the People's Committee of the special zone includes the Chairman, Vice Chairman and members.
The Chairman, Vice Chairman and Member of the People's Committee of the Special Zone are civil servants holding leadership and management positions of the People's Committee of the Special Zone, except for cases of arranging officers and professional soldiers of agencies and units under the People's Army; officers and non-commissioned officers of agencies and units under the People's Public Security holding the positions of Chairman, Vice Chairman and Member of the People's Committee of the Special Zone.
The specific number of Vice Chairmen and members of the People's Committee of the special zone is decided by the People's Committee at the provincial level to ensure streamlining, in accordance with the requirements for performing tasks and powers in the special zone and according to the Government's regulations on the number of Vice Chairmen, the number and structure of People's Committee members.
The People's Committee of the special zone is allowed to organize specialized agencies, other administrative organizations or arrange specialized civil servants to advise and assist the People's Committee of the special zone in state management of the sector and field.
