The Ministry of Home Affairs is seeking opinions on the draft Decree regulating civil servant job positions.
According to the draft, the Government will issue a unified job position list framework, replacing the previous mechanism of each ministries and branches issuing separate instructions.
The list includes 6 major groups: leadership and management positions; specialized professional expertise; general expertise; support and service; professional positions under the Provincial People's Council; and civil servant positions at the commune, ward, and special zone levels.
Along with that is a system of job description models and capacity frameworks for each type of position, from leadership position, senior expert to specialist and staff.
The Ministry of Home Affairs assesses that this mechanism helps unify the approach from the central to local levels, limiting the situation of each place building a separate system.
The draft submission of the Ministry of Home Affairs clearly states: the issuance of the Decree aims to concretize the provisions of the Law on Cadres and Civil Servants in 2025, and at the same time inherit the previously approved job job job job job description and job position categories.
According to the draft, by December 31, 2026 at the latest, ministries, branches and localities must complete and issue decisions approving the list of job positions according to new regulations. By July 1, 2027, all the arrangement and classification of civil servants according to approved job positions must be completed.
The draft clearly stipulates the cases where civil servants are expected to be assigned to job positions but do not fully meet the requirements. At that time, the head of the agency employing the civil servant must temporarily arrange a position corresponding to the current holding position for 12 months for the civil servant to complete.
After this deadline, if the requirements are still not met, the agency will consider arranging them to a position with a lower rank, or transfer them to another agency with a suitable position. If it is not possible to arrange, it is recommended to streamline the payroll according to regulations.
This regulation marks an important shift in the orientation of "lifelong elimination of staff", while creating a screening mechanism based on the ability to perform tasks, directly linked to job position requirements.
