On the morning of November 27, the National Assembly discussed in the hall the draft Law on Employment (amended).
Commenting on the draft law, delegate Pham Van Hoa (Dong Thap Delegation) said that the regulation that only poor and near-poor households in island districts and communes with special difficulties can borrow capital is unfair to poor and near-poor households in other places.
According to the delegate, such a regulation only provides support for especially disadvantaged communes, poor and near-poor households in ethnic minority areas, while poor households in other places are not supported. Such a regulation is unreasonable.
Therefore, the delegate proposed that there should be regulations to support all poor households, near-poor households, and especially disadvantaged communes nationwide to receive loan support.
Regarding the regulation on labor registration, delegate Pham Van Hoa said that this is a very new and important content, however, the regulation is not clear and distinct; at the same time, he wondered who is the agency or organization that registers labor and employment, the Department of Labor, War Invalids and Social Affairs or the Labor Department or the commune or ward?
According to the delegate, if commune and ward officials are responsible for registering more jobs, they will face many difficulties because they have to take on many jobs.
Therefore, the delegate suggested that the drafting committee further study the reasonableness of this issue. If it is not reasonable, it is recommended to remove this provision in chapter 3 to avoid causing complications for facilities in communes and wards.
Regarding the regulations on the Vocational Skills Council, the draft law stipulates that all ministries and branches at the central level must establish a Vocational Skills Council, with functions, tasks, and powers assigned to the Government for regulation.
Delegate Pham Van Hoa said that such a regulation is very inappropriate, only relevant ministries and sectors, relevant commune and ward People's Committees can establish a Vocational Skills Council for evaluation, while unrelated ministries and sectors do not necessarily need to be established. Therefore, he suggested that the drafting committee reconsider this regulation.
In addition, in assessing national vocational skills, delegates suggested that the draft law should clearly and specifically stipulate qualifications, abilities, academic titles and degrees.
Delegate Nguyen Minh Tam (Quang Binh Delegation) was concerned about the procedures for supporting workers. Accordingly, the delegate requested the draft law drafting committee to review the procedures and assign them to the Government for regulation.
The delegate said that it is necessary to thoroughly grasp the direction of the National Assembly Chairman in Document No. 15/CTQH dated October 29, 2024 on innovation in thinking in law-making, in the basic spirit of not prescribing administrative procedures, records, and procedural orders in the law but assigning them to the Government and Ministries to prescribe.
Through research, delegate Nguyen Minh Tam said that the draft law also has some provisions on administrative procedures such as:
Procedures for labor registration (Article 23); adjustment of employment information in the employee database (Article 25); procedures for supporting employers in training and improving vocational skills to maintain employment for employees (Article 63)...
Therefore, delegate Nguyen Minh Tam requested the agency drafting the draft law to study and review the removal of regulations on administrative procedures from the draft law and assign the Government to regulate this content.
