The Ministry of Home Affairs proposes to ban the establishment of funds to receive deposits, loans, and investment contributions, to ensure that the fund operates in accordance with its principles, purposes, and for non-profit purposes.

The Ministry of Home Affairs is soliciting opinions on the draft Decree of the Government on the organization and operation of social funds and charity funds.

One of the notable new regulations this time is the draft proposing to add regulations on the prohibition of establishing and organizing fund activities to carry out acts of receiving deposits, lending, and investment capital contributions.

This proposal aims to ensure that funds operate in accordance with their principles, purposes and for non-profit purposes.

The draft Decree also clearly stipulates the ownership rights and responsibilities for assets of founders, individuals, and organizations contributing assets and sponsoring them to the fund.

Regulate the expenditures to implement programs and projects from the source of expenditures to sponsor and support programs and projects according to the fund's regulations but not exceeding 7% to facilitate the organization and operation of the fund when implementing programs and projects according to the fund's principles and purposes.

In addition, based on official data on the consumer price index from 2019 - 2025 published by the General Statistics Office and the average consumer price increase rate in 2025 approved by the National Assembly at 4.5% - 5% in Resolution No. 192/2025 dated February 19, 2025, consumer prices in 2025 will increase by about 24% compared to 2019 (increasing by about 1.24 times).

At the same time, when implementing the Party's policy and the Law on Local Government on organizing local government at two levels including provincial and commune levels, the provincial and commune administrative boundaries have been expanded compared to before.

On that basis, according to the Ministry of Home Affairs, the regulation on the assets of Vietnamese organizations and citizens and foreign organizations and individuals contributing to the establishment of a fund as prescribed in the draft Decree increases by 1.24 times compared to the assets contributed by Vietnamese organizations and citizens and foreign organizations and individuals as prescribed in Article 14 of Decree No. 93/2019/ND-CP is in line with the Party's policy, regulating the law on the organization of local government at two levels including the provincial and commune levels.

At the same time, it is in line with the Party's policies and the provisions of the law on socio-economic development and ensuring national defense and security.
