Mr. Le Duy, residing in Quang Nam, mentioned the case of Mr. Nguyen Van A, a primary school teacher, with a salary coefficient of 4.89 at level 10 of the college system (Code V.07.03.08), currently receiving 10% seniority allowance beyond the framework, a seniority allowance coefficient of 36% for teachers, and a preferential allowance coefficient of 35%.
After that, Mr. A's professional title was changed to Primary School Teacher Grade III, salary coefficient 4.98 at level 9 of the university system (Code V.07.03.29), reserve difference coefficient 0.4, seniority allowance coefficient 36%, preferential allowance coefficient 35%.
When calculating Mr. A's salary, there is no basis to add the reserved difference coefficient to the salary coefficient according to the current rank and level to calculate the allowance level (teacher seniority, teacher incentives).
Therefore, Mr. Nguyen Van A's total salary is lower than the salary before the transfer (about 500 thousand VND), affecting Mr. A's rights.
"Therefore, I respectfully request the Ministry of Home Affairs to pay attention and provide guidance on whether the above salary calculation complies with current regulations or not? If it complies with regulations, we can base on the regulations at Point b, Clause 4, Section II of Circular 02/2007/TT-BNV to not rearrange the salary for Mr. Nguyen Van A" - Mr. Le Duy asked.
Regarding the reflection and recommendation of Mr. Le Duy, the Ministry of Home Affairs said: The transfer of salary classification when promoting a civil servant's professional title in cases where the total salary coefficient plus seniority allowance exceeding the framework currently enjoyed in the old rank (professional title) is greater than the salary coefficient at the last level in the new rank (professional title) is implemented according to the provisions in Point c, Clause 1, Section II of Circular 02/2007/TT-BNV dated May 25, 2007 of the Minister of Home Affairs guiding salary classification when promoting, transferring ranks, and changing types of civil servants and public employees.
In case of being classified into the salary coefficient at the last level in the new grade and enjoying an additional reserved difference coefficient equal to the total salary coefficient plus seniority allowance exceeding the current frame in the old grade, this reserved difference coefficient will be used as the basis for calculating allowances (teacher seniority allowance and preferential allowance for teachers).
The method of calculating the seniority allowance for teachers is implemented according to the civil servant regulations in Clause 3, Article 4 of Decree No. 77/2021/ND-CP dated August 1, 2021 of the Government.
The method of calculating the preferential allowance for teachers is implemented according to the civil servant regulations in Clause 2, Section II of Joint Circular No. 01/2006/TTLTBGD&DT-BNV-BTC dated January 23, 2006 of the Minister of Education and Training, the Minister of Home Affairs and the Minister of Finance guiding the implementation of Decision No. 244/2005/TTg dated October 6, 2005 of the Prime Minister.
The organization and implementation of regimes and policies for civil servants and public employees in provinces and centrally-run cities (provincial level) is under the authority of the Provincial People's Committee.
Therefore, the Ministry of Home Affairs recommends that Mr. Duy contact the specialized agencies of the People's Committee of Quang Nam province (Department of Home Affairs and Department of Education and Training) for answers.
