The Government has just issued Resolution 167/NQ-CP dated June 26, 2026 on applying the policy of streamlining staff for people working at the Military Command of communes, wards, and special zones who quit their jobs due to the reorganization of the Military Command (BCHQS) of communes, wards, and special zones according to Resolution No. 66/12/2026/NQ-CP dated January 26, 2026 of the Government.
The Government decided that people working at the Military Commands of communes, wards, and special zones (hereinafter referred to as commune-level Military Commands) resign due to the reorganization of the Military Command of commune level according to Resolution No. 66/12/2026/NQ-CP dated January 26, 2026 of the Government to apply the staff streamlining policy specified in Decree No. 154/2025/ND-CP dated June 15, 2025 of the Government.
In case when applying the above-mentioned staffing policy, if the staff reduction allowance for the job position being held is lower than the staff reduction allowance for the job position before recruiting civil servants according to Law No. 98/2025/QH15, it is allowed to choose to enjoy the most beneficial policy.
The Government assigns the People's Committees of provinces and centrally-run cities to direct agencies, organizations, and units under their management to compile a list of retired subjects; estimate the amount of money to implement policies for each case according to Decree No. 154/2025/ND-CP and the above content, and submit it to competent authorities for consideration and decision according to management decentralization, ensuring completion before September 1, 2026.
Article 8 of Decree No. 154/2025/ND-CP stipulates the resignation policy:
1. Immediate resignation policy
Subjects who have not reached retirement age as prescribed in Appendix I, Appendix II issued together with Decree No. 135/2020/ND-CP and do not meet the conditions to enjoy the pre-retirement policy specified in Article 6 of this Decree, if they quit immediately, are entitled to the following regimes:
a) Be entitled to a 3-month salary allowance to find a job;
b) Be entitled to an allowance of 1.5 months of current salary for each year of work with compulsory social insurance contributions;
c) Being allowed to preserve the time of compulsory social insurance contribution or enjoying one-time social insurance benefits according to the provisions of the law on social insurance.
2. Dismissal policy after vocational training
Subjects under 45 years old, with health, sense of responsibility and organizational discipline but undertaking jobs that are not suitable in terms of training level, training major, and wishing to quit their jobs, are facilitated by agencies, organizations, and units to go to vocational training before resolving resignation, find new jobs themselves, and enjoy the following regimes:
a) Be entitled to the current salary and be paid by the agency or unit for social insurance, health insurance, and unemployment insurance (if subject to unemployment insurance) during vocational training, but the maximum benefit period is 06 months;
b) Being subsidized with a vocational training fund equal to the cost of a vocational training course of a maximum of 06 months of current salary to pay to a vocational training institution;
c) After completing vocational training, be subsidized 3 months of current salary at the time of studying to find a job;
d) Be entitled to a subsidy of 0.5 months of current salary for each year of work with social insurance contributions;
e) During the time of vocational training, continuous working time is counted but seniority is not counted for annual regular salary increases.
e) Being allowed to preserve the time of compulsory social insurance contribution or enjoying one-time social insurance benefits according to the provisions of the law on social insurance.
