On July 15, the National Assembly Standing Committee gave opinions on the draft Law amending and supplementing a number of articles of the Law on Vietnamese workers going to work abroad under contract (draft Law).
According to Member of the Party Central Committee, Minister of Home Affairs Do Thanh Binh, the amendment and supplementation of the above Law in the current context is an urgent requirement, with profound political and practical significance.
First of all, the amendment aims to promptly and fully institutionalize the Party's guidelines and policies on perfecting institutions, arranging organizational structures, promoting decentralization, delegation of power and digital transformation in state management.
In addition, the amendment of the Law also aims to unlock and maximize social resources, and solve "bottlenecks" caused by regulations that are no longer appropriate.
At the same time, improve the competitiveness of Vietnamese enterprises in the international labor supply market.
The content of amendments and supplements to the draft Law is organized closely following 4 groups of issues, in which the following are prominent:
Regarding administrative procedures, the draft Law does not generate new administrative procedures; abolishes 5/19 administrative procedures; cuts and simplifies 6/19 administrative procedures, cuts 34% of compliance costs for people and businesses.
Removing unnecessary regulations to unlock social resources, improve the proactiveness and flexibility of businesses, especially in recruiting, training, and preparing labor resources towards improving the quality of Vietnamese human resources in the international labor market.
Abolishing the component of dossiers that are business registration certificates for administrative procedures for registering labor supply contracts and registering internship labor contracts; abolishing business conditions that require deposits for businesses sending workers to training to improve skills abroad.
Supplementing regulations on licensing conditions, restricting businesses or legal representatives of businesses that have had their licenses revoked due to legal violations but still "circumvent the law" to continue proposing licensing for other businesses.
Transfer the management mechanism for winning bids, receiving bids, and investing abroad from "approvement" to "notice"; delegate the authority to receive notices of labor source preparation to the commune-level People's Committee.
Concluding this content, Member of the Party Central Committee, Vice Chairman of the National Assembly Nguyen Thi Thanh noted to review prohibited acts, responsibilities of enterprises and commune-level authorities.
The draft law needs to clearly stipulate the obligation to report, provide legal support and handle cases and emergency situations affecting workers such as the issue of fraudulent businesses, and at the same time study to increase sanctions for this act.
The Vice Chairman of the National Assembly emphasized the need to cut administrative procedures, shorten licensing time, and reduce the financial burden for service businesses and people participating in labor export.
