On September 24, continuing the 37th session, the National Assembly Standing Committee (NASC) gave opinions on the draft Law amending and supplementing a number of articles of the Law on Advertising.
At the meeting, Minister of Culture, Sports and Tourism Nguyen Van Hung said that in order to overcome the remaining problems and create favorable conditions for advertising activities to develop, the development of a draft law amending and supplementing a number of articles of the Advertising Law is a necessary requirement in the current period.
The basic content of the draft Law closely follows the purpose, guiding viewpoints and concretizes the content of the 3 policies in the Proposal for Law making that was approved by amending and supplementing the provisions of the 2012 Law on Advertising.
In which, amend and supplement Article 19 on requirements for advertising content: Advertising content must ensure honesty, accuracy, clarity, and not cause misunderstanding about the features, quality, uses, and effects of products, goods, and services.
In case the advertisement includes notes or recommendations, the notes or recommendations must be presented clearly, completely, and easily accessible; and the content of the advertisement must be defined.
Amend and supplement the provisions in Clause 4, Article 20 on conditions for advertising special goods and services to ensure updating and adjustment to comply with the procedures and names of types of licenses prescribed by specialized laws.
The person delivering the advertising product has the following responsibilities: Providing documents related to advertising content, revenue, product name, quantity of each product arising from periodic advertising activities as required by the tax authority or when requested by a competent state agency...
Representative of the agency examining the draft Law, Chairman of the National Assembly's Committee on Culture and Education Nguyen Dac Vinh said that the Standing Committee agreed with the necessity of amending and supplementing a number of articles of the 2012 Advertising Law for the reasons stated in the Government's Submission.
In addition, the appraisal agency requested the Government to continue researching, supplementing and perfecting a number of documents of the draft Law dossier, ensuring completeness and accuracy.
The review agency proposed to study and supplement the responsibilities of the Ministry of Industry and Trade in implementing state management of advertising content for special products, goods and services under its management. Study and supplement the responsibilities of the Ministry of Public Security in handling violations in advertising activities related to network security and social order and security.
Regarding the rights and obligations of the person transmitting advertising products (Clause 4, Article 1 of the draft Law supplementing Article 15a), the Standing Committee agrees with the policy of having specific and clear regulations on the rights, obligations and responsibilities of the person transmitting advertising products, including the person transmitting advertising products who is an influential person.
