According to the Government Electronic Information Portal on the morning of September 17, the Government has just issued Resolution No. 279/NQ-CP agreeing to approve the draft Law on Public Employees (amended) submitted by the Ministry of Home Affairs.
The amendment of the Law on Civil Servants is an important content, attracting the attention of many civil servants nationwide due to its impact on the attraction, arrangement, use, treatment, training and fostering of civil servants. Especially in the context of the two-level local government having just been in operation for a short time.
Notably, in Resolution No. 279, the Government assigned the Minister of Home Affairs to be responsible for receiving opinions from Government members, completing the dossier of the draft Law on Civil Servants (amended); authorized the Prime Minister, on behalf of the Government to sign the Government's Submission on the draft Law and related documents to submit to the National Assembly according to regulations.
The Minister of Home Affairs is also assigned to closely coordinate with the agencies of the National Assembly; proactively report and explain during the review process, accept the opinions of the National Assembly Standing Committee, of the National Assembly on the draft Law in accordance with the provisions of the Law on Promulgation of Legal Documents and be responsible for the content of the report.
Information from the Ministry of Home Affairs said that the draft Law on Civil Servants (amended) is designed according to the principle of inheriting and revising the contents of the Law on Civil Servants 2010 (amended and supplemented in 2019) to comply with the new regulations of the Party and in accordance with the principles and goals with specific contents.
The draft Law on Public Employees (amended) focuses on perfecting the human resource management mechanism in the direction of taking workers as the center, creating flexibility in the use of public-private human resources, creating mechanisms in attracting high-quality human resources, cutting down on administrative procedures, overcoming limitations and shortcomings of current laws, while meeting the requirements of national governance innovation, building a team of professional, responsible, dynamic civil servants and serving the people.
The draft Law on Civil Servants (amended) also focuses on reviewing and supplementing policies in the direction that public service units are proactive in the management and use of human resources, in line with the new policies of the Politburo and practice.
The goal is to form a flexible mechanism in recruitment for public service units to attract, arrange, use, treat, train, and foster civil servants, employees, experts, and scientists, in accordance with the human resource needs and financial conditions of the unit; allowing public service units to operate as economic entities (for autonomous units);
Thereby creating a flexible mechanism in recruitment, evaluation, and use in accordance with the level of autonomy on the basis of ensuring the principle of community service; creating a flexible team management mechanism in the direction of openness, adapting to all organizational models; creating a sufficient open mechanism for each unit to "process" the way of managing, using, and recruiting its own team.
