Increasing decentralization and delegation of authority to Hanoi City
On the morning of December 8, at the 10th Session of the 15th National Assembly, Minister of Finance Nguyen Van Thang submitted to the National Assembly a draft Resolution of the National Assembly to pilot a number of specific mechanisms and policies to implement major and important projects in the capital.
The draft Resolution is arranged into 12 Articles, with 7 groups of specific mechanisms and policies to implement major and important projects in the capital.
Regarding the authority to decide and approve investment policies, to increase decentralization and delegation of authority to the city; at the same time, shorten the approval time, improve proactiveness but still ensure strict supervision, the draft Resolution stipulates: The City People's Council and the Chairman of the City People's Committee are allowed to decide on investment policies and approve investment policies for public investment projects, PPP, private projects that are not limited in capital scale, land use, resettlement requirements, ... under the authority of the National Assembly, the Government, the Prime Minister according to current regulations.

The City People's Council issued procedures for establishing, appraising, deciding on investment policies, approving investment policies, and adjusting project investment policies for implementation.
Regarding the content of land recovery, land allocation, land lease, when there is an approved detailed plan and policy to allow implementation of the City People's Council. The City People's Committee will use the city budget to implement an independent compensation and resettlement support project before approving the project investment policy according to the direction of competent authorities.
In addition to the cases specified in Article 79 of the Land Law, the City People's Council decides on each specific case of land recovery and allows the city to temporarily allocate a part of the land within the project scope to start construction when receiving instructions from competent authorities. The projects need to be implemented immediately according to the direction of competent authorities. The City People's Council decides on the compensation and resettlement support level twice as prescribed.
In other cases, the City People's Council decides on a higher level than the prescribed level but not more than twice. Based on the BT project proposal, the City People's Committee divides the overall project into component projects and determines the land fund expected to be allocated for payment for each component project, and decides to pay in advance for each component land fund after signing a BT contract for each component project.

Proposed to simplify many procedures
The draft resolution also stipulates that Hanoi City is allowed to carry out planning procedures and construction initiation procedures in parallel with procedures for approving investment policies for urgent projects.
Along with that, it is proposed to eliminate some procedures: Abolish procedures for establishing, appraising, and approving planning tasks for zoning plans, urban and rural detailed planning; do not have to take an architectural design competition for works when necessary...
Regarding measures to renovate, embellish and rebuild urban areas, the draft Resolution stipulates that the City People's Committee is assigned to decide on measures to renovate, embellish and rebuild urban areas: Destroy apartment buildings and apartment buildings with one or a number of works with inspection results with level of danger.
The competent authority approving the planning shall decide on the demographic architectural planning indicators at projects in the historic inner city area exceeding the regulations in the general planning and urban zoning planning. Decide on measures to enforce demolition when over 75% of home owners and land owners equivalent to at least 75% of the land area of the renovation, renovation and reconstruction area agree.
After reviewing, the National Assembly's Economic and Financial Committee agreed with the necessity, the political basis and the practical basis for issuing the Resolution according to a shortened order and procedure.
However, he noted that for special mechanisms and policies with a large scope of impact such as expanding land acquisition cases, decentralizing decision-making authority, approving investment by the National Assembly, the Prime Minister to Hanoi city, enforcing when reaching 75% of consensus..., to ensure sufficient legal and political basis, request reporting to competent authorities, and at the same time carefully assessing legal, economic and social impacts, ensuring that there are no complicated complaints or complaints, affecting social stability and people's trust, in accordance with the Constitution and the Party's policies.
