The Ministry of Justice reduces 5 units, leaving 20 units after the reorganization

The Government has just issued Decree No. 39/2025/ND-CP dated February 26, 2025, stipulating the functions, tasks, powers and organizational structure of the Ministry of Justice.

According to the Government's Decree, the Ministry of Justice assists the Government in reviewing legal documents issued by ministries, ministerial-level agencies, People's Councils, Provincial People's Committees and local authorities in administrative-economic units; recommends handling illegal documents according to legal regulations.

The Ministry of Justice helps the Government unify the management of law enforcement on handling administrative violations nationwide according to legal regulations; at the same time, helps the Government unify state management of legal support for small and medium-sized enterprises nationwide according to legal regulations.

The Decree stipulates the organizational structure of the Ministry of Justice consisting of 20 units, down 5 compared to before:

1. The Department of Legal Document Development.

2. Department of Criminal and Administrative Law.

3. Department of Civil and Economic Law.

4. International Law Department.

5. Department of Organization and Personnel.

6. Department of International Cooperation.

7. Ministry Inspectorate.

8. Ministry Office.

9. Department of Civil Judgment Enforcement Management.

10. Department of Document Inspection and Administrative Violation Management.

11. Department of Legal Dissemination and Education and Legal Assistance.

12. Department of Judicial Administration.

13. The State Registration Department of Guarantee and Compensation Transactions.

14. Department of Judicial Assistance.

15. Department of Planning and Finance.

16. Department of Information Technology.

17. Institute of Strategy and Legal Science.

18. Academy of Justice.

19. Democracy and Law Magazine.

20. Vietnam Law Newspaper.

Thus, the Ministry of Justice no longer has: Department of adopted children; National Center for Judicial Records; Department of National Registration of Transactions to ensure merger with the Department of State Compensation; Department of Civil status, nationality, certification; Department of Legal Dissemination and Education to merge with the Department of Legal Assistance.

Organizations 1 to 16 are administrative organizations that assist the Minister in performing state management functions; organizations 17 to 20 are public service units serving state management under ministries.

The Department of Legal Document Development has 3 departments, the Department of Criminal and Administrative Law has 3 departments, the Department of Civil and Economic Law has 4 departments, the Department of International Law has 4 departments, the Department of Organization and Personnel has 5 departments, the Department of International Cooperation has 3 departments.

The Minister of Justice shall prescribe the functions, tasks, powers and organizational structure of units under the ministry and submit to the Prime Minister for promulgation a list of other public service units under the ministry.

The Decree also clearly states that the General Department of Civil Judgment Enforcement continues to perform its duties and powers according to legal regulations until a decision of the Minister of Justice stipulates the functions, tasks, powers and organizational structure of the Department of Civil Judgment Enforcement Management takes effect.

This Decree takes effect from March 1, 2025, replacing Decree No. 98/2022/ND-CP.
