According to reports from 62/63 provinces and centrally-run cities nationwide, there have been 384 work accidents (TNLD) causing 404 cases of workers working without labor contracts to have the accident.
Of which: The number of cases of labor accident deaths is 140, causing 143 deaths and 144 serious injuries.
Localities with the largest number of deaths from TNLD in 2024: Ho Chi Minh City, Hanoi, Quang Ninh, Thai Nguyen, Thai Binh, An Giang.
According to the Ministry of Home Affairs, in 2024, localities have conducted a record of the investigation of labor fraud, quickly reporting deaths in labor fraud for employees with contracts and not under contracts.
However, the rapid reporting of labor deaths has not been implemented promptly and fully by localities such as: Thanh Hoa, Hai Phong, Ha Tinh, Bac Ninh, Thai Nguyen.
"The investigation of labor relations in areas without labor contracts has not been fully implemented according to the provisions of law. The recording of labor contracts for employees working without labor contracts implemented by the People's Committees at the commune level is still very limited" - the announcement of the Ministry of Home Affairs clearly stated.
Sharing with PV Lao Dong newspaper, Ms. Chu Thi Hanh - Deputy Director of the Department of Employment (Ministry of Home Affairs) said that the Ministry of Home Affairs has reviewed a series of legal documents related to decentralization and decentralization in the field of occupational accidents investigation, quality of occupational accidents reports.
In reality, in the field of labor accident investigation and labor accident reporting quality, there has been a clear decentralization and delegation of authority to the district and commune levels.
However, according to the Deputy Director of the Department of Employment, in areas with labor relations, the organization and implementation of occupational safety and health work from the central to local levels still faces difficulties in funding.
This situation also occurs in areas without labor relations.
Regarding the main solutions that need to be implemented in 2025, the Ministry of Home Affairs recommends that ministries, localities, enterprises, organizations, employers, and employees pay attention to implementing many contents.
In particular, the Ministry of Home Affairs requests the People's Committees of provinces and centrally run cities to direct competent agencies at the representative level to strengthen inspection and examination of compliance with occupational safety and health regulations of enterprises in the area;
Especially in areas with many risks of occupational accidents and serious incidents, pay attention to the activities of developing processes and safe working measures at enterprises, promptly reporting the risk of occupational accidents and deaths, and recording the investigation of occupational accidents according to the Law on occupational safety and health.
Strengthen the organization of labor contracts investigation for employees working without labor contracts, focusing on the quality of labor contracts investigation.
The Ministry of Home Affairs is seeking opinions on the draft Law on Organization of Local Government (MO ago) amendment. The draft Law is expected to be submitted to the National Assembly at the upcoming 9th session.
One of the notable points in the draft Law is to amend regulations related to the determination of tasks and powers of provincial and grassroots trade unions; promote decentralization and delegation between the Central and local levels and between provincial and grassroots trade unions.
