Ms. Nguyen Thi Binh (character's name has been changed) - a part-time worker at the commune level has just sent a petition to the Ministry of Home Affairs regarding the determination of the allowance coefficient to calculate the staff streamlining regime according to Decree No. 154/2025.
According to Ms. Binh, Clause 2, Article 5 of Decree 154/2025 stipulates: The current monthly allowance for part-time workers in villages and communes is calculated according to the allowance level of the month immediately preceding the retirement, and the central budget will reserve a fund for the locality to pay.
However, in Decree No. 33/2023, the allowance contract for part-time workers at the commune level is divided into the classification of communes: type 1 communes are allocated 21 months of basic salary; type 2 communes are 18 months; and type 3 communes are 15 months.
From the above regulations, Ms. Binh wonders: "When applying the current allowance coefficient to calculate the staff streamlining regime according to Decree 154/2025, how will the specific level be determined? Will a general rate of 1.5 be applied nationwide? ".
Regarding Ms. Binh's reflection and recommendation, the Ministry of Home Affairs responded on the Electronic Information Portal.
Pursuant to the provisions of Clause 2, Article 5 of Decree No. 154/2025 dated June 15, 2025 of the Government, Clause 1, Article 34 of Decree No. 33/2023 dated June 10, 2023 of the Government, the current monthly allowance received by non-professional workers at the commune level, in villages and residential groups to calculate the allowance for staff reduction is the allowance of the month immediately preceding the retirement period due to the central budget allocating the allowance fund for payment, calculated according to the type of commune-level administrative unit as prescribed in Decree No. 33/2023.
Therefore, the Department of Organization and Intermediate Affairs (Ministry of Home Affairs) has requested citizens to study the above documents to comply with regulations.
