On the afternoon of June 3, the National Assembly Standing Committee gave its opinion on the reception, explanation, and revision of the draft Law on Cadres and Civil Servants (amended).
The latest draft law has stipulated the use of results of monitoring, evaluating, and classifying the quality of civil servants.
Based on the results of quality monitoring, assessment, and classification, competent authorities will consider and decide: Carry out training, fostering, planning, mobilizing, recruiting, reappointing, or arranging to higher positions; implement salary regimes, regimes, and other policies according to the provisions of law and regulations of competent authorities.
Implement rewards, additional income regimes, bonuses according to regulations; consider, arrange to lower job positions or dismiss those who do not complete their tasks or do not meet the requirements of the tasks. The draft law assigns the Government to specify this in detail.
The draft Law on Cadres and Civil Servants (amended) stipulates disciplinary measures for civil servants.
Civil servants who violate the provisions of this Law and other relevant legal provisions, depending on the nature and severity of the violation, must undergo one of the following forms of discipline: Reprimand; warning; dismissal (applicable to civil servants in leadership and management positions); forced to resign.
Civil servants sentenced to prison by the Court without a suspended sentence or convicted of a corruption crime shall of course be forced to quit their jobs from the date the verdict or decision takes effect; civil servants holding leadership or management positions for crimes sentenced by the Court and whose judgments or decisions have come into legal effect shall of course stop holding positions due to appointment.
Based on the level of violation and the form of disciplinary action, cadres and civil servants subject to disciplinary action will also be subject to corresponding regulations on extending the appointment period to higher positions, regulations on recruitment, termination of employment, salaries, bonuses and other relevant regulations.
Cadres and civil servants who are under disciplinary action, being investigated, prosecuted, or tried are not allowed to be nominated, nominated, appointed, transferred, rotated, seconded, trained, or fostered.
Cadres and civil servants who are disciplined and dismissed due to corruption will not be appointed to leadership or management positions.
The head of the competent authority managing cadres and civil servants may decide to temporarily suspend cadres and civil servants in cases where cadres and civil servants are found to have signs of violations in performing their duties or at the request of the competent authority.
