On the afternoon of May 14, according to the agenda, the National Assembly discussed in the hall the draft Law on Cadres and Civil Servants (amended).
This draft law is expected to create an important legal basis for screening and removing from work those who do not have the qualities, capacity, and prestige to leave the apparatus.
One of the important amendments and supplements is that the draft Law has converted the method of managing cadres and civil servants according to job positions.
Remove the regulation on promotion exams, instead, the mechanism for arranging to any job position is classified as a corresponding civil servant rank, associated with capacity and performance results. This regulation aims to create real motivation for cadres and civil servants to strive.
The draft law innovates the work of recruiting civil servants in the direction of appointed people, salary classification at civil servant ranks corresponding to the job position of the recruited and not having to undergo probationary regime.
In reality, in the past, evaluating cadres and civil servants was a difficult problem, because the criteria were still general. To overcome this situation, the draft law has been amended and supplemented in the direction of improving the effectiveness of assessment, use and screening of cadres and civil servants.
Accordingly, the regulation on evaluating cadres and civil servants must be based on the results of performing specific tasks and work products according to the requirements of the job position.
And a new point that is highly appreciated by voters and public opinion is that this draft law has added a mechanism to eliminate the lifelong staffing thinking. At the same time, clearly stipulate the responsibility of the head in managing, evaluating and using civil servants with the right capacity and job position.
At a recent group discussion session, Minister of Home Affairs Pham Thi Thanh Tra said that this is an opportunity to comprehensively change the thinking and philosophy for the civil service and public employees of our country.
In particular, clearly establish job positions because they will be a tool, a guiding principle, a center, a core in recruitment, use, management, fostering, rewarding, and discipline.
According to the Minister, this amendment still maintains the civil servant rank in the job position. This is considered a technical tool to determine the rank of public services in our country, if it is removed, it will be very difficult to determine.
"We still keep the line to implement and implement salary reform. If the civil servant ranks are removed, it will be very difficult to design issues related to mechanisms and policies," the Minister added.
The Minister also emphasized that we must overcome the lifelong staffing thinking. Therefore, it is necessary to design a mechanism to " enter and exit", completely abolishing the payroll for life.
To do so, it is necessary to implement 2 tools including assessment based on job position and use of contract mechanism (experts' contracts, scientists, job positions). This is a common trend in the world.
"There will be a separate decree on assessment, with KPI, data for assessment, taking work products as a measure, not a general assessment", the Minister of Home Affairs added.
