Standing Deputy Prime Minister Nguyen Hoa Binh has just signed Official Dispatch No. 85/TTg-V.I of the Prime Minister on strengthening strict compliance with administrative procedure law and administrative judgment enforcement.
The Prime Minister directs the People's Committees and Chairmen of the People's Committees of provinces and cities to focus on directing the strict implementation of the provisions of the Law on Administrative Procedures on the responsibility to participate in dialogue, participate in court sessions and provide documents and evidence in administrative cases where state agencies and competent persons in state agencies are sued.
Directing the review and assignment of responsibilities of each agency, unit, and individual and clearly defining the deadline and detailed roadmap for organizing the definitive enforcement of judgments and decisions of the Court on administrative cases that have taken effect and the People's Committee and the Chairman of the People's Committee are the parties to enforce the judgment, absolutely not allowing the situation of "three no's", not participating in litigation, not appealing when disagreeing with the judgment or decision, and not organizing enforcement when the judgment or decision has taken effect in the state administrative apparatus in the locality.
People's Committees and Chairmen of People's Committees of provinces and cities shall direct the organization of inspection, examination, consideration and handling of responsibilities for organizations and individuals who have acts of delayed judgment enforcement, non-compliance, improper or incomplete compliance with the contents of judgments and decisions of the Court.
At the same time, include the content of administrative judgment enforcement work in the annual work program and plan of People's Committees at all levels. Supplement the criteria for evaluating administrative judgment enforcement results into the criteria for evaluating and ranking the level of task completion and evaluating emulation and commendation for departments, agencies, branches and People's Committees of communes, wards, and special zones in the province and city.
Implement and direct the strict implementation of Article 31 of Decree No. 71/2016/ND-CP dated July 1, 2016 of the Government stipulating the time limit, order, procedures for administrative judgment enforcement and handling responsibilities for judgment debtors who do not enforce judgments and decisions of the Court on not considering emulation and commendation.
Not evaluating and classifying at the level of good completion of tasks, excellent completion of tasks for officials, civil servants, and public employees who violate the law on administrative judgment enforcement.
Strengthen discipline and order in administrative judgment enforcement, the responsibility of the head, identifying this as one of the contents that need to be considered in the work of evaluating, planning, and appointing officials.
People's Committees and Chairmen of People's Committees of provinces and cities direct to improve the effectiveness of coordination between departments, agencies, branches, People's Committees of communes, wards, and special zones in the province and city in administrative judgment enforcement work.
Closely coordinate with the procuracy and civil judgment enforcement agencies in the area in the process of these agencies performing the function of supervising and monitoring administrative judgment enforcement in accordance with the provisions of the Law on Administrative Procedures and Decree No. 71/2016/ND-CP.
