The National Assembly has passed the Law on Civil Judgment Enforcement. This law takes effect from July 1, 2026.
The law stipulates that the civil judgment enforcement agency is the agency with the function of organizing the enforcement of judgments and decisions according to the provisions of this Law and relevant legal regulations.
Civil judgment enforcement agencies have Heads and Deputy Heads with legal status, seals with the national emblem, headquarters and private accounts. The head of the civil judgment enforcement agency is the Head of the civil judgment enforcement agency.
The organizational structure of the provincial and city civil judgment enforcement agencies includes units such as: Professional and Civil Judgment Enforcement Department; Regional Civil Judgment Enforcement Department; other department-level units.
The Minister of Justice stipulates the names, functions, tasks, powers and organizational structure of civil judgment enforcement agencies of provinces and cities. The Minister of National Defense stipulates the names, functions, tasks, powers and organizational structure of military-region-level judgment enforcement agencies.
The law also clearly stipulates the tasks and powers of provincial and city civil judgment enforcement agencies.
Typically, there is the preparation of dossiers requesting consideration for exemption and reduction of civil judgment enforcement obligations; coordination with competent authorities in preparing dossiers requesting consideration for amnesty, considering reducing the term of imprisonment for judgment debtors.
Managing, directing, guiding nghiep vu, inspecting, and urging civil judgment enforcement work in provinces and cities; ensuring the uniform application of legal regulations in civil judgment enforcement activities.
In addition, resolving complaints and denunciations about civil judgment enforcement is under the authority of this Law.
At the same time, helping the Provincial People's Committee to perform responsibilities, tasks, and powers regarding civil judgment enforcement in accordance with the law.
Report to the People's Council and the Provincial People's Committee on the results of civil judgment enforcement; the revision, supplementation, interpretation of judgments, decisions, and resolution of court recommendations;
Report on coordination and other contents in civil judgment enforcement activities in accordance with the law; report to the Court on the results of judgment enforcement and decisions when requested.
