The Government has issued Decree 09/2026/ND-CP stipulating the functions, tasks, powers and organizational structure of the Ministry of Justice.
Supplementing state management functions on administrative procedure control
Decree No. 09/2026/ND-CP clearly states that the Ministry of Justice is an agency of the Government, performing state management functions on: Law-making; organizing law enforcement; civil judgment enforcement; administrative and judicial; judicial support; legal affairs; controlling administrative procedures (TTHC); state management of public service services in fields under the Ministry's state management.
Thus, the Ministry of Justice is assigned additional functions on administrative procedure control.
The Ministry of Justice performs tasks and powers according to the provisions of the Law on Organization of the Government, the Government's regulations on functions, tasks, powers and organizational structure of the Ministry, ministerial-level agencies and 23 tasks and powers.
Regarding administrative procedure control, the Ministry of Justice has the task of guiding, monitoring, urging, and inspecting the implementation of administrative procedure control by ministries, branches, and provincial-level People's Committees; summarizing the situation and results of implementation, and reporting to the Government and the Prime Minister.
Presiding over the implementation of administrative procedure reform tasks and the one-stop shop mechanism, inter-agency one-stop shop in resolving administrative procedures at state administrative agencies; communication work on administrative procedure reform.
Organizational structure includes 20 units
The organizational structure of the Ministry of Justice includes 20 units.
Among them, 16 units are administrative organizations that help Ministers perform state management functions: Department of Legal normative document development; Department of Organization and Personnel; Department of International Cooperation; Ministry Office; Department of Civil Judgment Enforcement Management; Department of Criminal Law - Administrative Law and Management of Administrative Violations; Department of Civil Law - Economics; Department of International Law and International Investment Dispute Resolution; Department of Document Inspection and Law Enforcement Organization; Department of Legal Dissemination and Legal Assistance; Department of Judicial Administration; Department of Registering secured transactions and State Compensation; Department of Judicial Assistance; Department of Administrative Procedure Control; Department of Planning - Finance; Department of Information Technology; 4 organizations are public non-business units serving state management under the Ministry: Institute of Strategy and Legal Science; Academy of Justice; Journal of Democracy and Law; Vietnam Law Newspaper.
Regarding the transition clause, the Decree also clearly states that the task of directing, monitoring, guiding professional and nghiep vu, inspecting bailiff work; managing organizations and activities of bailiffs will continue to be implemented until the Law on Civil Judgment Enforcement No. 106/2025/QH15 takes effect.
The task of state management of judicial assistance and being the focal point for implementing civil judicial assistance continues to be implemented until the Law on Mutual Legal Assistance for Civil Affairs No. 102/2025/QH15 takes effect.
The Department of Administrative Procedure Control shall perform the tasks and powers on administrative procedure control specified in this Decree from the time the decision of the Minister of Justice stipulating the functions, tasks, powers and organizational structure of the Department of Administrative Procedure Control takes effect.
Decree 09/2026/ND-CP takes effect from January 10, 2026.
