Ms. Hoang Thi Oanh (character's name has been changed) was born in 1988, and has been a commune office worker for 10 years.
Ms. Oanh wondered, when merging communes, if she voluntarily applied for resignation from work from June 2025, will she be entitled to the regime prescribed in Decree 178/2024 (amended and supplemented in Decree 67/2025?
Regarding Ms. Oanh's reflection and recommendation, the Ministry of Home Affairs has responded on the Electronic Information Portal.
On April 26, 2025, the Ministry of Home Affairs issued Document No. 1814 guiding the implementation of Decree No. 178/2024 and Decree No. 67/2025 of the Government.
In which, Point d, Clause 3, Section II of Document No. 1814 provides guidance for cases of cadres, civil servants, public employees and commune-level cadres and public employees due to the arrangement of district and commune-level administrative units.
Accordingly, cadres, civil servants, public employees and commune-level cadres and public employees due to the arrangement of district and commune-level administrative units in the period of 2019 - 2021 and the period of 2023 - 2025 according to the Resolution of the National Assembly Standing Committee who retire after January 1, 2025 are subject to the provisions of Point b, Clause 1, Article 2 of Decree No. 178/2024 (amended and supplemented in Decree No. 67/2025).

Therefore, the Ministry of Home Affairs recommends that Ms. Oanh base on the instructions in Document No. 1814 above to compare whether she is a subject or not.
