The Government has just issued Decree 67/2025/ND-CP amending policies for cadres, civil servants, public employees, workers, and armed forces in restructuring the apparatus.
The Decree has stipulated the adjustment of regimes for some groups of cadres to facilitate the arrangement of personnel at the Party Committee level.
In particular, this decree applies to cadres who are not old enough to be re-elected or reappointed; cadres who are old enough to be re-elected or re-appointed to the same-level Party Committee but have a remaining working time of 2.5 to 5 years until retirement age; and cadres in charge of the Party Committee at all levels whose remaining working time is not more than 5 years until retirement age, wish to retire early and are approved by competent authorities.
If these officials have had their benefits resolved according to Decree 177/2024/ND-CP but the benefit level is lower than the new regulation in Decree 67, they will be granted a compensation for the difference.
Decree 67 also applies to cases that are in the process of resolving the regime due to the arrangement of the apparatus and administrative units at district and commune levels from 2023, but the competent authority has not issued a decision, or those who quit after January 1, 2025.
In cases where policies and regimes have been resolved by competent authorities according to the provisions of Decree No. 178/2024/ND-CP, if the policies and regimes are lower than the policies and regimes prescribed in this Decree, they will be supplemented according to the policies and regimes prescribed in this Decree.
The Decree also stipulates the responsibility of the heads of agencies, organizations and units to directly manage and use cadres, civil servants and public employees when implementing policies and regimes as prescribed in this Decree.
Based on the instructions of competent authorities on evaluating cadres, civil servants, public employees and workers and specific evaluation criteria according to the instructions of competent authorities, heads of agencies, organizations and units shall collect the collective opinions of leaders of Party committees and authorities at the same level to issue evaluation criteria.
Conduct a comprehensive review of the quality of cadres, civil servants, public employees and workers under management, consider voluntary resignation applications of cadres, civil servants, public employees and workers.
From there, it is determined that the subjects must quit their jobs due to streamlining the organizational apparatus, streamlining the payroll, restructuring and improving the quality of the team of cadres, civil servants, and public employees, improving the effectiveness and efficiency of activities.
Make a list and estimate the amount of policy implementation for each case, submit to competent authorities for consideration and approval.
After being approved by competent authorities, policies and regimes will be promptly paid to cadres, civil servants and public employees in accordance with the provisions of law.
