Allowance regime for civil servants who have become commune-level civil servants

From July 1, 2025, cases recruited as civil servants in accordance with the provisions of law will be subject to civil service.

Ms. Nguyen Quynh (character's name has been changed) learned that Clause 4, Article 11 of Resolution No. 76/2025/UBTVQH15 dated April 14, 2025 of the National Assembly Standing Committee on the arrangement of administrative units in 2025 stipulates: Cadres, civil servants, and public employees affected by the arrangement of administrative units but still working in agencies and organizations under the political system will be kept the same salary regime and policies and position allowances (if any) for 6 months from the date of the work arrangement document. After this period, the regimes, policies and position allowances will be applied according to the provisions of current law.

"When implementing the two-level local government model, civil servants converted to commune-level civil servants will receive a 25% public service allowance and a 30% allowance for the Party and mass organizations (if working at the Commune Party Committee) or not?" - Ms. Quynh wondered.

Regarding Ms. Quynh's recommendation, the Ministry of Home Affairs responded on the Electronic Information Portal.

Accordingly, the public service allowance regime is implemented according to the provisions of Decree 34/2012/ND-CP dated April 15, 2012 of the Government, in which Article 2 of this Decree stipulates the subjects applying the public service allowance regime.

Pursuant to the Law on Cadres and Civil Servants 2025, the Government issued Decree No. 170/2025/ND-CP dated June 30, 2025 regulating the recruitment, use and management of civil servants.

Accordingly, from July 1, 2025, if recruited as civil servants in accordance with the provisions of law, the civil service regime will be applied.
