The Government has just issued Decree No. 190/2026/ND-CP detailing a number of articles of the Law on Emergency Situations; in which, it clearly stipulates policies for organizations and individuals participating in activities in an emergency situation.
For people receiving salaries from the state budget, the Decree stipulates that the agency or organization where that person works pays the full salary according to rank, rank, rank, position; position allowances, seniority allowances, regional allowances and other allowances according to the provisions of law throughout the duration of performing tasks;
In addition to the above regulations, hazardous and dangerous hazards allowances are also entitled according to the actual working day in an emergency situation with the following benefits:
Level 1: Equal to 0.2 times the base salary calculated per day when performing tasks in an emergency situation.
Level 2: Equal to 0.3 times the base salary calculated per day when performing tasks in an emergency situation with hazardous, dangerous elements or working in areas affected by natural disasters, epidemics, and serious disasters.
Level 3: Equal to 0.4 times the base salary calculated per day when performing tasks in an emergency situation with particularly toxic, dangerous elements, with a high risk of affecting life and health;
Civil servants, public employees, and employees on overtime duty at the Steering Committee, Command Board, and Standing Office on emergency situations are entitled to overtime salaries according to the Government's regulations detailing and guiding the implementation of a number of articles of the Labor Code on working conditions, labor relations and other relevant legal regulations.
For people who do not receive salaries from the state budget, during the time they are mobilized to perform tasks in an emergency situation according to the decision of the competent authority, they are entitled to working day allowances and meal allowances as for the militia mobilized to perform tasks according to the Decree detailing a number of articles of the Law on Militia and Self-Defense Forces on organizing force building and regimes and policies for militia and self-defense forces;
In case of performing duties at night (from 10 pm the previous day to 6 am the next day), they are entitled to an additional working day allowance of no less than 50% of the current working day allowance level mentioned above.
In addition to the above regulations, they are also entitled to an additional working day allowance due to hazards and dangers when performing tasks in an emergency situation calculated according to the actual working day, with the following benefit levels:
Level 1: Equal to 0.5 times the labor day allowance level specified in point a when performing tasks in an emergency situation.
Level 2: Equal to 0.7 times the labor day allowance level specified in point a when performing dangerous, toxic tasks or working in areas affected by natural disasters, epidemics, and serious disasters.
Level 3: Equal to 1.0 times the labor day allowance level specified in point a when performing tasks in an emergency situation with particularly toxic, dangerous elements, with a high risk of affecting life and health;
The Government assigns Ministers of ministries in the field of state management to regulate the level of toxicity, danger, and especially danger when working in an emergency situation in cases where the law has not stipulated.
This Decree takes effect from July 13, 2026.
