On September 3, the Government Office announced that the Government had just issued Decree No. 237/2025/ND-CP amending and supplementing a number of articles of Decree No. 105/2012/ND-CP dated December 17, 2012 of the Government on organizing funerals for cadres, civil servants and public employees.
Accordingly, cadres, civil servants and public employees who are working or retiring from death will be held a funeral according to one of the following rituals: National Funeral Ceremony, State-level Funeral Ceremony, High-level Funeral Ceremony, Funeral Ceremony for cadres, civil servants and public employees.
Changes in funeral rituals outside the cases specified in this Decree shall be implemented in accordance with the provisions of competent authorities.
Decree 237/2025/ND-CP amends and supplements a number of clauses of Article 5 of Decree No. 105/2012/ND-CP on the title of holding a National Funeral, including adding regulations on cases of resignation due to violations and shortcomings.
In case a person dies while holding one of the positions of General Secretary; President; Prime Minister; Chairman of the National Assembly, or is dismissed from office, retired from work, or retired early, or retired according to regulations due to violations or shortcomings, the funeral will be held according to the High-level Funeral procedure.
The Decree also amends and supplements Article 21 of Decree No. 105/2012/ND-CP on the title of State-level Funeral Ceremony.
Accordingly, cadres holding or ceasing to hold one of the following positions when resigning from office will be held at the State Funeral Service: Politburo member, Secretary of the Party Central Committee; Vice President; Vice Prime Minister; Vice President of the National Assembly; Chairman of the Central Committee of the Vietnam Fatherland Front; Chief Justice of the Supreme People's Court; Chief Justice of the Supreme People's Procuracy; General of the People's Armed Forces; Senior Lieutenant General of the People's Armed Forces who were revolutionary activists before the August 1945 uprising.
In case a person who passes away from holding one of the above positions is allowed by competent authorities to resign from office, retire early, retire according to regulations due to violations or shortcomings, the funeral will be held according to high-level funeral procedures; disciplined by dismissal or removal of position, title, and funeral will be held according to the Funeral ceremony for cadres, civil servants, and public employees.
Regarding the title of holding a high-level funeral, the Decree amends and supplements Article 34 of Decree No. 105/2012/ND-CP as follows: Cadres and civil servants holding or ceasing to hold positions under the management of the Politburo and the Central Party Secretariat (except for positions held at the National Funeral and State-level funerals).
Cadres working in the revolution before January 1, 1945 (resolutionary veterans) were awarded the First Class Independence Medal or higher; cadres working in the South during the anti-US period (1954 1975) were awarded the First Class Independence Medal or higher; outstanding social, cultural and scientific activists ( awarded the Ho Chi Minh Prize - individual award) and were awarded the First Class Independence Medal or higher.
Outstanding social, cultural and scientific activists (assigned the Ho Chi Minh Prize - individual award) are Heroes of the People's Armed Forces, Heroes of Labor who are working or retiring from death and are held at a high-level Funeral ceremony.
In case the person who dies and holds one of the above positions is disciplined by being dismissed or having his/her status removed from the position or title, the funeral will be held according to the Funeral ceremony for cadres, civil servants and public employees.
In the case of a person who passed away as a member of the Party Central Committee (except for positions held at the National Funeral Ceremony and State Funeral Ceremony) and is given a competent authority to resign from his position, retire early, retire early according to regulations due to violations and shortcomings, the funeral will be held according to the Funeral ceremony for cadres, civil servants, and public employees.
